Book Foreign Trade Investment and the Law in the People s Republic of China

Download or read book Foreign Trade Investment and the Law in the People s Republic of China written by Michael J. Moser and published by Oxford University Press, USA. This book was released on 1987 with total page 624 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the adoption of an 'open-door' economic policy in 1978, foreign trade with the People's Republic of China has increased dramatically. At the same time, 'new' forms of economic activity, such as compensation trade, licensing, co-operative production and equity joint ventures have becomepossible for the first time. In order to regulate the nation's expanded and increasingly complex business activity, the Chinese government has, during the past few years, promulgated scores of new laws relating to business transactions involving foreigners; many others are now being drafted. This book, now extensively revised and updated in a second edition, provides an introduction to the legal framework currently being developed in China with respect to foreign commerical and investment activity. The eighteen chapters in the volume, each written by a lawyer with practical experience in China trade, deal with such matters as customs regulations, taxation, representative offices, leasing, the transfer of technology, foreign investment, contracts, banking, dispute settlement, the framework oflaw in the special investment zones and in offshore oil production, China's environmental law and patent law, trade marks, sovereign immunity and the foreign regulation of trade with China. In addition, the book includes a valuable appendix containing a list of China's most important foreigneconomic legislation.

Book China s Foreign Policy

Available in PDF, EPUB and Kindle. Book excerpt: China’s inexorable rise as a major world power is one of the defining features of the contemporary political landscape. But should we heed the warnings of a so-called ‘China threat?’ Is China set to become the next superpower? Or will its ambitions be tempered by economic and political realities both at home and abroad? In this insightful and balanced analysis, noted China expert Stuart Harris explores China’s present foreign policy and its motivations, focusing in particular on the extent to which China will co-operate with the West in years to come. He considers what factors, international or domestic, will influence the foreign policies being shaped in Beijing, including how far the Chinese regime will adhere to existing global norms and the evolving international system. In contemplating this uncertain future, Harris assesses the considerable challenges and vulnerabilities likely to impact on Chinese foreign policy, leading it to be cautious and hesitant or assertive and aggressive on the international stage. Concise and authoritative, this book will be essential reading for anyone seeking a clearer understanding of the international relations of one of the world’s most important powers.

Book excerpt: China's entry into the World Trade Organization (WTO) in 2001 was heralded as historic, and for good reason: the world's most populous nation was joining the rule-based system that has governed international commerce since World War II. But the full ramifications of that event are only now becoming apparent, as the Chinese economic juggernaut has evolved in unanticipated and profoundly troublesome ways. In this book, journalist Paul Blustein chronicles the contentious process resulting in China's WTO membership and the transformative changes that followed, both good and bad - for China, for its trading partners, and for the global trading system as a whole. The book recounts how China opened its markets and underwent far-reaching reforms that fuelled its economic takeoff, but then adopted policies - a cheap currency and heavy-handed state intervention - that unfairly disadvantaged foreign competitors and circumvented WTO rules. Events took a potentially catastrophic turn in 2018 with the eruption of a trade war between China and the United States, which has brought the trading system to a breaking point. Regardless of how the latest confrontation unfolds, the world will be grappling for decades with the challenges posed by China Inc.

Download or read book China Trade and Power written by Stewart Paterson and published by London School of Economics and Political Science. This book was released on 2018-10-18 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: From a Western point of view, the policy of economic engagement with China has failed. A rapid rise in living standards in China has helped legitimize and strengthen the Chinese Communist Party's power. How did Western, market-orientated, property-owning, liberal democracies go from being in a position of complete global hegemony in the early 1990s to the current crisis of confidence and loss of moral foundation? This book tells the story of the most successful trading nation of the early twenty-first century. It looks at how the Communist Party of China has retained and cemented its monopoly on political power since China's accession to the World Trade Organization in December 2001. It is the most extraordinary economic success story of our time and it has reshaped the geopolitics not just of Asia but of the world. As China has come to dominate global manufacturing, its economic power has been translated into political power, and the West now has a global rival that is politically antithetical to liberal values. The supply-side deflation from allowing 750 million low-cost workers into the global trading system combined with the policy of inflation targeting by Western central banks has led to falling real incomes for many in the West and rising asset prices that have benefited the few. Worse still, China's mercantilist model is now held up as a viable economic alternative. To have a fighting chance of protecting the freedoms of liberal democracies, it is of the utmost importance that we understand how the policy of indulgent engagement with China has affected Western society in recent years. Only then can the global trading system be reoriented for the mutual benefit of all nations.

Book excerpt: In recent decades, Asia’s ascent has been contextualized as the rise of two major neighboring countries in Asia – India and China. Besides voluminous work on the prospects and convergences between the two, currently they stand at an intersection of time where suspicion and mistrust veils the confidence. A degree of uncertainty arises from the more profound paradoxes, and India has been falling short in escaping the tailspin China has created in the bilateral, regional and global economic dynamics. India’s China relations is not just about boundaries and boycott of Chinese products. The root of the relationship lies in deficiency of trust, knowledge, and repository of experts on China. To deal with India’s China Tailspin effectively, one must know and comprehend China thoroughly. This book brings out several aspects of India’s political-economic relations with China on the table. The book underlines the fact that while leveraging China’s inherent contradictions, India has to deleverage from China’s subtle global aspirational designs of domination. Besides analyses on leadership, state capitalism, and geo-economics, the book describes special cases such as the Trade War, Structural Conflicts in Chinese Political Economy, Bangladesh-China-India-Myanmar Economic Corridor, WTO negotiations, Maritime trade, Belt and Road Initiative, and Taiwan to better elaborate the stakes involved in dealing with China. The recent boundary tension created a long tailspin, which in turn set off a raucous debate over China’s economic diplomacy and how India could comprehend it well. Book China and the WTO

Download or read book China and the WTO written by Petros C. Mavroidis and published by Princeton University Press. This book was released on 2021-01-05 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: "China's accession to the World Trade Organisation (WTO) in 2001 was hailed as the natural conclusion of a long march that started with the reforms introduced by Deng Xiaoping in the 1970s. However, China's participation in the WTO since joining has been anything but smooth, and its self-proclaimed "socialist market economy" system has alienated many of its global trading partners - as recent tensions with the United States exemplify. Prevailing diplomatic attitudes tend to focus on two diametrically opposing approaches to dealing with the emerging problems: the first is to demand that China completely overhaul its economic regime; the second is to stay idle and accept that the WTO must accommodate different economic regimes, no matter how idiosyncratic and incompatible. In this book, Mavroidis and Sapir propose a third approach. They point out that, while the WTO (as well as its predecessor, the General Agreement on Tariffs and Trade [GATT]) has previously managed the accession of socialist countries or of big trading nations, it has never before dealt with a country as large or as powerful as China. Therefore, in order to simultaneously uphold its core principles and accommodate China's unique geopolitical position, the authors argue that the WTO needs to translate some of its implicit legal understanding into explicit treaty language. Focusing on two core complaints - that Chinese state-owned enterprises (SOEs) benefit from unfair trade advantages, and that domestic companies (both private as well as SOEs) impose forced technology transfer on foreign companies as a condition for accessing the Chinese market - they lay out their specific proposals for successful legislative amendment"--.
