Book excerpt: This book analyses current developments in Europe and Latin America towards the greater involvement of the parties in the administration of criminal justice. Focusing on both national criminal proceedings and transnational cases, this study employs a comparative law approach to examine the shift experienced by Italy and Brazil from the long tradition of mixed criminal justice to unprecedented adversarial trends. The identification of common needs and divergences from the national approach to criminal justice paves the way for a subsequent analysis of new solution models emerging from international human rights law and EU law. To a great extent, these developments are due to the increasing impact of international human rights case-law on the criminal justice systems of the countries in question. The book concludes by proposing a set of qualitative requirements for a participatory model of criminal justice.

Oggetto di attenzione costituiscono, in particolare: - la L. 24 dicembre 2012, n. 228 (Legge di stabilità 2013) che ha introdotto importanti novità in materia di giustizia digitale, da un lato rendendo obbligatorio, a partire dal 30 giugno 2014, il deposito per via telematica degli atti processuali, dall’altro sancendo l’ingresso della posta elettronica certificata anche nella procedura del pignoramento presso terzi; - la L. 17 dicembre 2012, n. 221 (di conversione del D.L. 179/2012, cosiddetto decreto sviluppo-bis), che, con l’obiettivo di dare ulteriore impulso al processo di digitalizzazione della giustizia, ha arricchito il quadro delle regole necessarie al funzionamento a regime del processo telematico, disponendo che nei procedimenti civili le notificazioni e le comunicazioni a cura della cancelleria vanno effettuate esclusivamente per via telematica; - la L. 7 agosto 2012, n. 134 (di conversione del D.L. 83/2012, cosiddetto decreto sviluppo), che è intervenuto sulla giustizia civile innovando la disciplina delle impugnazioni sia di merito che di legittimità, allo scopo di migliorarne l’efficienza ed evitare la sistematica violazione dei tempi di ragionevole durata del processo; - la L. 28 giugno 2012, n. 92 (cd. riforma Fornero) che, nel quadro di una rivisitazione globale della disciplina in tema di licenziamenti individuali, ha introdotto un rito speciale abbreviato per le controversie aventi ad oggetto l’impugnativa del licenziamento ed eventuali problematiche di qualificazione del rapporto di lavoro ad esso collegate. Si dà conto, inoltre, dell’importante sentenza n. 272/2012 con cui la Corte costituzionale ha dichiarato l’illegittimità costituzionale dell’art. 5 del D.Lgs. 28/2010 nella parte in cui ha previsto l’obbligo della mediazione quale condizione di procedibilità della domanda giudiziale in un numero importante ed eterogeneo di controversie, nonché, in via consequenziale, delle altre disposizioni le quali presuppongono che in alcune ipotesi la mediazione sia obbligatoria per legge. Based on a fair trial immediacy requirement, the Court has found several violations of Article 6 of the European Convention on Human Rights at the appellate level by at least eighteen States of the Council of Europe in a vast array of cases, particularly in contexts of first instance acquittals overturning and of sentences increasing on appeal. On the one hand, the book critically engages this case-law with the law revisions it has recently inspired in European countries, as well as with the critiques and difficulties that it continues to raise. On the other hand, it interweaves insight from criminal procedure theory with new discoveries in the field of cognitive sciences (neuroscience of memory, philosophy of knowledge, AI), shedding an interdisciplinary light on the (in)adequacy and limits of the Strasbourg Court’s jurisprudence.

Book excerpt: This book explores the European Public Prosecutor’s Office (EPPO), the creation of which was approved in the Regulation adopted by the Justice and Home Affairs (JHA) Council on 12 October 2017. The EPPO will be an independent European prosecution office tasked with investigating and prosecuting those crimes defined in the recently adopted Regulation 2017/1371 on combating fraud against the Union’s financial interests by means of criminal law. As such, it will be a new actor on the EU landscape, governed by the principle of loyal cooperation with the national prosecuting authorities. This work clarifies some of the challenges that member states will have to face when dealing with a supranational prosecution authority. In addition, it provides guidelines on how to implement the present Regulation while respecting the fundamental rights of defendants in criminal proceedings. The book is of special interest in so far as the analysis and perspective of academics is completed with the contributions of legal experts who have either been involved in the negotiations to establish the European public prosecutor or will be closely linked, as public prosecutors, to the functioning of the future European public prosecutor’s office.
