Book excerpt: The Commentary on the Treaty on the Functioning of the European Union (four volumes) is a major European project that aims to contribute to the development of ever closer conceptual and dogmatic standpoints with regard to the creation of “Europeanised research on Union law”. Following on from the Commentary on the Treaty of the European Union, this book presents detailed explanations, article by article, of all the provisions of the TFEU, discussing the application of Union law in the national legal orders and its interpretation by the Court of Justice of the EU. The authors are academics and practitioners from twenty-eight European states and different legal fields, some from a constitutional law background, others experts in the field of international law and EU law.Reflecting the various approaches to European legal culture, this book promotes a system concept of European Union law toward more unity notwithstanding its rich diversity grounded in national traditions.

Book Security versus Justice

Download or read book Security versus Justice written by Florian Geyer and published by Routledge. This book was released on 2016-04-01 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the most dynamic areas of EU law since the great changes brought to the EU constitutional order by the Amsterdam Treaty in 1999 has been cooperation in the fields of policing and criminal justice. Both fields have already been the subject of substantial legislative effort in the EU and an increasing amount of judicial activity in the European Court of Justice. In 2007 - after the Constitutional Treaty of 2004 failed - the new Reform Treaty planned very substantive changes to these policies. Bringing together a wide-ranging set of topics and contributors, this book enables readers to understand these changes by examining three key questions: how did we get to the Reform Treaty; what have been - and still are - the key struggles in competence; and how do the changes fit into the transformation of police and judicial cooperation in criminal matters in the EU?

Book European Union Intergovernmental Conference

Download or read book European Union Intergovernmental Conference written by Great Britain: Parliament: House of Commons: European Scrutiny Committee and published by The Stationery Office. This book was released on 2007-10-09 with total page 80 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union Intergovernmental Conference (IGC) opened on 23 July 2007 and was initiated following a report originally produced by the German Presidency on the "Treaty establishing a Constitution for Europe" (Constitutional Treaty, Cm.6429, ISBN 9780101642927), which in turn led to a "Draft IGC Mandate" setting out a detailed prescription on issues raised by the above report, circulated by the Presidency of the European Council. The report itself recommended a "Reform Treaty" which would amend existing treaties and so required an intergovernmental conference. The European Scrutiny Committee has set out a number of conclusions, including: the Committee questioned the aims of the European Council in engaging with EU citizens on the EU Constitution whilst setting out changes to the constitution in an essentially secretive manner; that the substance of the Reform Treaty is substantially equivalent to the Constitutional Treaty itself; the Committee is concerned about the UK's position under the Charter; that the UK retains opt-outs that were previously arranged under the Constitutional Treaty will still be retained under the Reform Treaty; that the proposals in the Reform Treaty raise a serious difficulty of a constitutional order, appearing to impose a legal duty on national parliaments to the European Union itself, the Committee calls such a legal duty on Parliament, objectionable, and states that as a matter of principle it should be resisted.

Book Europe s Foreign and Security Policy

Available in PDF, EPUB and Kindle. Book excerpt: The emergence of a common security and foreign policy has been one of the most contentious issues accompanying the integration of the European Union. In this book, Michael Smith examines the specific ways foreign policy cooperation has been institutionalized in the EU, the way institutional development affects cooperative outcomes in foreign policy, and how those outcomes lead to new institutional reforms. Smith explains the evolution and performance of the institutional procedures of the EU using a unique analytical framework, supported by extensive empirical evidence drawn from interviews, case studies, official documents and secondary sources. His perceptive and well-informed analysis covers the entire history of EU foreign policy cooperation, from its origins in the late 1960s up to the start of the 2003 constitutional convention. Demonstrating the importance and extent of EU foreign/security policy, the book will be of interest to scholars, researchers and policy-makers.

The IGC will have to try and resolve tensions such as: "widening" Europe to include former communist countries whislt also trying to "deepen" Europe with increased political and economic integration; providing a framework which is acceptable to a core of countries (Benelux, Germany, France) who favour more integration and an early move to monetary union with countries such as the UK, which does not.

Book How the EU Really Works

Download or read book How the EU Really Works written by Olivier Costa and published by Routledge. This book was released on 2016-04-29 with total page 429 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union is facing a profound crisis and is confronted with multiple challenges. Over the last two decades, it has experienced a series of dramatic changes to its powers, its institutional design, its constitutional framework and its borders. At the same time, the uneasy relationship between European citizens and elites has complicated both the reform and the function of the Union. While the Lisbon treaty provided some answers to crucial questions, it did not clarify the nature of the EU, which remains at the crossroads of federal and intergovernmental logic. The current economic and financial crisis puts the EU’s legitimacy further under pressure and creates the impression of a turning point. This book provides a concise analysis of the EU and its dynamics by paying particular attention to its day to day operation. It aims to help students and scholars understand its evolution, its institutions, its decision-making and the interactions between the EU and various actors. Avoiding abstract theorizing, the authors propose an easy to read analysis of how the Union works while recognizing the complexity of the situation. Throughout the book, the key issues of European integration are addressed: democratic deficit, politicization, the role of member states, institutional crisis and citizen involvement.
