Book excerpt: First published in 1966. The main object of the present work is to trace the process whereby the land of this country came into agricultural use under full individual control. That movement, as will be seen, is treated as continuous and as due in the main to the operation of large economic and, so to say, normal causes. While the rapidity and extent of inclosure varies from time to time, and while its kind undergoes certain changes, progress continues.

Download or read book English Urban Commons written by Christopher Rodgers and published by Taylor & Francis. This book was released on 2023-11-15 with total page 229 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book presents a novel examination of urban commons which provides a robust base for education initiatives and future public policy guidance on the protection and use of urban commons as invaluable urban green spaces that offer a diverse cultural and ecological resource for future communities. The book's central argument is that only through a deep understanding of the past and a rigorous engagement with present users, can we devise new futures or imaginaries of culture, well-being and diversity for the urban commons. It argues that understanding the genesis of, and interactions between, the different pressures on urban green space has important policy implications for the delivery of nature conservation, recreational access and other land use priorities. The stakeholders in today’s urban commons, whether land users, policy makers or the public, are the inheritors of a complex cultural legacy and must negotiate diverse and sometimes conflicting objectives in their pursuit of a potentially unifying goal: a secure future for our urban commons. The book offers a unique and strongly interdisciplinary study of urban commons, one that brings together original historical investigation, contemporary legal scholarship, extensive oral history research with user groups, and research examining the imagined futures for the urban common in modern society. It explores the complex social and political history of the urban common, as well as its legal and cultural status today, using four diverse case studies from within England as exemplars of the distinctively urban common. These are Town Moor in Newcastle, Mousehold Heath in Norwich, Clifton and Durdham Downs in Bristol and Valley Gardens in Brighton. The book concludes by looking forward and considering new tools and methods of negotiation, inclusivity and creativity to inform the future of these case studies, and of urban commons more widely. This book will be of great interest to students and scholars of the commons, green spaces, urban planning, environmental and urban geography, environmental studies and natural resource management.

Book English Administrative Law from 1550

Download or read book English Administrative Law from 1550 written by Paul Craig and published by Oxford University Press. This book was released on 2024-05-09 with total page 785 pages. Available in PDF, EPUB and Kindle. Book excerpt: The commonly held view about English administrative law is that it is of recent origin, with some dating it from the mid-20th century and some venturing back to the late 19th century. English Administrative Law from 1550: Continuity and Change upends this conventional thinking, charting its development from the mid-16th century with an in-depth examination of administrative law doctrine based on primary legal materials, statute, and case law. This book is divided into four parts. Part 1 sets out the book's principal thesis, contrasting standard perceptions concerning the existence of English administrative law with the reality of its emergence from the mid-16th century. Part 2 is concerned with Regulation and Administration from the mid-16th century to the end of the 19th century. There is detailed analysis of the regulatory and administrative state, which includes chapters on the way in which administrative policy was developed through individual decision-making and rulemaking, and the role played by contract in service delivery. Part 3 deals with Courts and Doctrine. It begins with discussion of foundational precepts followed by chapters on natural justice; review of law and fact; rights; delegation, fettering and purpose; reasonableness; proportionability; prerogative; and third and fourth source power. Part 4 of the book covers Remedies and Review, with chapters on invalidity; standing; the prerogative writs; injunction, declaration, quo warranto and habeas corpus; and damages and restitutionary liability. With thought-provoking and original insights, English Administrative Law from 1550 systematically elaborates and contextualizes the origins of administrative law features while linking them to their modern-day equivalents.
