Book excerpt: Lessons from the experience of using PFI can be applied to improve other forms of procurement and help Government achieve its aim of securing annual infrastructure delivery cost savings of £2 billion to £3 billion. To secure the best value for money from all types of procurement, the public sector needs to develop skills the NAO has identified. These are collecting better data to inform decision-making; ensuring projects have the right skills; establishing effective arrangements to test, challenge and, if necessary, stop projects; and using commercial awareness to obtain better deals. The case for using private finance in public procurement needs to be challenged more. Also, privately financed projects will often still be off balance-sheet which may continue to act as an incentive to use PFI. There has not been a systematic value for money evaluation of operational PFI projects by departments. So there is insufficient data to demonstrate whether the use of private finance has led to better or worse value for money than other forms of procurement. The Treasury and departments should identify alternative methods for delivering infrastructure and related facilities services to maximise value for money for government. The NAO welcomes the current plans of the Treasury and Cabinet Office to strengthen project assurance. The report highlights the need for independent challenge capable of stopping projects which do not give the prospect of value for money. This is particularly important as there is still a shortage of the skills needed to manage and oversee complex major projects.

Book excerpt: Under the Private Finance Initiative (PFI) there are now 800 contracts with private sector suppliers for services worth in total £155 billion up to 2032. To achieve value for money, all stages of a project have to be managed effectively, including in the tendering process. The Committee, in a 2003 report highlighted a number of issues regarding the PFI tendering process (HCP 764, session 2002-03, ISBN 9780215011244). This report re-examines the tendering and benchmarking in PFI, finding that the Treasury had done little to apply what it had learned from the large number of PFI deals signed; that there has been no improvement in tendering times and significant risks to value for money continue to be taken when public authorities make late changes to deals. The Committee has set out 7 conclusions and recommendations, including: that since 2004, the proportion of deals attracting only two bidders has more than doubled with the risk of no competition; one third of public sector teams made changes to PFI projects after they had selected a single, preferred bidder; benchmarking and market testing have increased prices by up to 14%; public authorities have found it difficult to find appropriate data to benchmark PFI service costs; there is evidence that public authorities, faced with price increases have had to cut back services in hospitals, including portering, to keep contracts affordable; that there is a continuing lack of PFI experience and skills within public procurement teams.

Book excerpt: The rural broadband programme is designed to help get superfast broadband to areas, predominately rural, where commercial broadband infrastructure providers currently have no plans to invest. The Department provides grant funding to 44 bodies (local authorities or groups of authorities) to subsidise them to procure superfast broadband for their areas, and a framework contract for local bodies to use. But the procurement approach failed to deliver meaningful competition. The Department appointed only two bidders - BT and Fujitsu - to the framework contract. By June 2013 all of the 26 contracts agreed by local bodies had gone to BT and, following Fujitsu's March 2013 announcement that it would not be bidding for any more local contracts, BT is likely to win the remaining 18. The Department's assumptions in its 2011 business case about the respective capital contributions of the public and private sectors were wildly inaccurate. BT is committing £207 million less in capital funding than anticipated, while local authorities are contributing £236 million more. BT will eventually benefit from owning assets created from £1.2 billion of public funding. The lack of transparency over BT's costs is a serious risk to value for money, particularly as BT is now the single supplier. The Department has allocated a further £250 million to increase coverage of superfast broadband in 2015-19, but does not yet have a clear plan for reaching 100% coverage. Ofcom's review of the broadband market presents an ideal opportunity to reconsider whether the regulatory regime is doing enough to promote competition.
