Book Localisation of Damage in Private International Law

Download or read book Localisation of Damage in Private International Law written by Olivera Boskovic and published by BRILL. This book was released on 2024-07-14 with total page 554 pages. Available in PDF, EPUB and Kindle. Book excerpt: Localisation in private international law of torts is a notoriously difficult question. How do you localize financial or moral damage? What about latent damage? Should damage in the context of cyber-torts be localized differently? The great variety of tortious actions gives rise to endless difficulties ranging from banal situations involving material damage to climate change. Trying to find suitable solutions requires answering many difficult questions, such as the very definition of damage within the meaning of private international law rules, the influence of various considerations such as foreseeability, protection of the claimant, and the remedy sought. The contributions in this volume address these questions and more from the perspectives of 17 different countries, from Austria to Venezuela.

Book European Traditions in Civil Procedure

Download or read book European Traditions in Civil Procedure written by C. H. van Rhee and published by Intersentia nv. This book was released on 2005 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: European co-operation has resulted in many new and challenging opportunities for legal scholars who, since the so-called 'codification period', have become used to operating in a purely national context. This applies also to scholars in the field of civil procedure, who, for a considerable period of time, have resisted leaving the purely national domain. These scholars have devoted a great deal of attention to the question whether or not harmonisation of civil procedural law is a feasible option, and, if so, in what manner harmonisation should be achieved. The contributors to this book seek to further the harmonisation debate by exploring some of the main trends in the development of civil procedural law during the last two centuries in several European countries (Germany, Austria, Switzerland, France, England and Wales, The Netherlands and Belgium). Two of the central issues that are addressed by the contributors are the extent to which the various procedural models have influenced each other and the extent to which common traditions in civil procedural law may be distinguished in Europe. Each general chapter in this book is supplemented by three chapters devoted to specific procedural topics: Conciliation, Party Interrogation as Evidence and the Role of the Judge. In addition, extensive bibliographical references are included.

Book The School of Montaigne in Early Modern Europe

Download or read book The School of Montaigne in Early Modern Europe written by Warren Boutcher and published by Oxford University Press. This book was released on 2017-03-09 with total page 567 pages. Available in PDF, EPUB and Kindle. Book excerpt: This major two-volume study offers an interdisciplinary analysis of Montaigne's Essais and their fortunes in early modern Europe and the modern western university. Volume one focuses on contexts from within Montaigne's own milieu, and on the ways in which his book made him a patron-author or instant classic in the eyes of his editor Marie de Gournay and his promoter Justus Lipsius. Volume two focuses on the reader-writers across Europe who used the Essais to make their own works, from corrected editions and translations in print, to life-writing and personal records in manuscript. The two volumes work together to offer a new picture of the book's significance in literary and intellectual history. Montaigne's is now usually understood to be the school of late humanism or of Pyrrhonian scepticism. This study argues that the school of Montaigne potentially included everyone in early modern Europe with occasion and means to read and write for themselves and for their friends and family, unconstrained by an official function or scholastic institution. For the Essais were shaped by a battle that had intensified since the Reformation and that would continue through to the pre-Enlightenment period. It was a battle to regulate the educated individual's judgement in reading and acting upon the two books bequeathed by God to man. The book of scriptures and the book of nature were becoming more accessible through print and manuscript cultures. But at the same time that access was being mediated more intensively by teachers such as clerics and humanists, by censors and institutions, by learned authors of past and present, and by commentaries and glosses upon those authors. Montaigne enfranchised the unofficial reader-writer with liberties of judgement offered and taken in the specific historical conditions of his era. The study draws on new ways of approaching literary history through the history of the book and of reading. The Essais are treated as a mobile, transnational work that travelled from Bordeaux to Paris and beyond to markets in other countries from England and Switzerland, to Italy and the Low Countries. Close analysis of editions, paratexts, translations, and annotated copies is informed by a distinct concept of the social context of a text. The concept is derived from anthropologist Alfred Gell's notion of the 'art nexus': the specific types of actions and agency relations mediated by works of art understood as 'indexes' that give rise to inferences of particular kinds. Throughout the two volumes the focus is on the particular nexus in which a copy, an edition, an extract, is embedded, and on the way that nexus might be described by early-modern people.

Book Dalhuisen on Transnational Comparative Commercial Financial and Trade Law Volume 1

Download or read book Dalhuisen on Transnational Comparative Commercial Financial and Trade Law Volume 1 written by Jan H Dalhuisen and published by A&C Black. This book was released on 2014-07-18 with total page 728 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the fifth edition of the leading work on transnational and comparative commercial and financial law, covering a wide range of complex topics in the modern law of international commerce, finance and trade. As a guide for students and practitioners it has proven to be unrivalled. Since the fourth edition, the work has been divided into three volumes, each of which can be used independently or as part of the complete work. Volume one covers the roots and foundations of private law; the different orientations and structure of civil and common law; the concept, forces, and theoretical basis of the transnationalisation of the law in the professional sphere; the autonomous sources of the new law merchant or modern lex mercatoria, its largely finance-driven impulses; and its relationship to domestic public policy and public order requirements. Volume two deals with transnational contract, movable and intangible property law. Volume three deals with financial products and financial services, with the structure and operation of modern commercial and investment banks, and with financial risk, stability and regulation, including the fall-out from the recent financial crisis and regulatory responses in the US and Europe. All three volumes may be purchased separately or as a single set. From the reviews of previous editions: "...synthesizes and integrates diverse bodies of law into a coherent and accessible account...remarkable in its scope and depth. It stands alone in its field not only due to its comprehensive coverage, but also its original methodology. Although it appears to be a weighty tome, in fact, in light of its scope, it is very concise. While providing a wealth of intensely practical information, its heart is highly conceptual and very ambitious...likely to become a classic text in its field." American Journal of Comparative Law "Dalhuisen's style is relaxed...what he writes convinces without the need for an excess of references to sources...a highly valuable contribution to the legal literature. It adopts a useful, modern approach to teaching the young generation of lawyers how to deal with the increasing internationalisation of law. It is also helpful to the practising lawyer and to legislators." Uniform Law Review/Revue de Droit Uniforme "this is a big book, with big themes and an author with the necessary experience to back them up. ... Full of insights as to the theories that underlie the rules governing contract, property and security, it is an important contribution to the law of international commerce and finance." Law Quarterly Review "...presents a very different case: that of a civilized and cultivated cosmopolitan legal scholar, with a keen sense of international commercial and financial practice, with an in-depth grounding in both comparative legal history and comparative law, combined with the ability to transcend conventional English black-letter law description with critical judgment towards institutional wisdom and intellectual fashions. ...a wide-ranging, historically and comparatively very deep and comprehensive commentary, but which is also very contemporary and forward-looking on many or most of the issues relevant in modern transnational commercial, contract and financial transactions..." International and Comparative Law Quarterly This title is included in Bloomsbury Professional's International Arbitration online service.

Book excerpt: Over the past two thousand years, Western legal systems have had to alter some of their most basic principles in order to regulate the giving of gifts. This is a study of how legal concepts from the marketplace have been reshaped to accommodate a fundamentally different type of social practice. Richard Hyland examines the law of gifts in England, India, and the United States, and in Belgium, France, Germany, Italy, and Spain. Giftsalso surveys the extensive discussion about gift giving in anthropology, history, economics, philosophy, and sociology. In addition, Hyland offers a critique of the functionalist method in comparative law and demonstrates the benefits of an interpretive approach.
