Book excerpt: Desde que se tuvo noticias de la Ley para Protección de las Familias, la Maternidad y la Paternidad de 2007, se sintió la necesidad de escudriñar su contenido, pues ella representó el primer intento de adecuación de algunas instituciones de Derecho de Familia a las normas de la Constitución de 1999. Aunque la obra legislativa fue tímida -y de ello son una muestra cuantitativa los escasos 38 artículos que la componen-, fueron bastante polémicas sus innovaciones, generando diversos reproches por parte de la doctrina especializada, muchos de ellos fundados en las claras fallas de técnica legislativa. Las complicaciones de la cátedra, sumado a otros proyectos desarrollados en el área del Derecho Civil, dificultó que progresara la idea de glosar la Ley, pero como el destino es misterioso, con la cuarentena que hemos tenido que guardar recientemente, coincidió el tiempo y la disposición para emprender un plan metodológico adecuado para acometer y concluir esta modesta obra que obsequiamos a los lectores. Básicamente, el objetivo es exponer en una primera parte algunos aspectos teóricos relacionados con la necesidad de esta Ley, sus antecedentes, fundamentos, principios y caracteres, para que así el lector tenga a la mano una visión panorámica de las instituciones que se explicaría con más detalle posteriormente. De seguida comentar cada artículo de la Ley, para lo cual se explica la disposición en una sección de comentario, se indican las observaciones críticas como reparo y se anotan las demás normas jurídicas relacionadas en concordancias. De allí su particular título que pretende servir de homenaje póstumo al profesor Arturo Luis Torres-Rivero quien nos obsequió su obra: Mis comentarios y reparos a la reforma del Código Civil en 1982 (UCV-Colegio de Abogados del Estado Lara. Caracas, 1984 vol. i y 1987 vol. ii); que a su vez se inspira en el estudio de Luis Ignacio Bastida: Comentarios y reparos al Proyecto de Código Civil (Editorial Bolívar. Caracas, 1939). Una precisión adicional: concluida la preparación de esta obra nos ente- ramos de la aprobación en primera discusión de un Proyecto de Ley para Protección de las Familias, la Maternidad y la Paternidad (abril de 2021) y por ello se consideró oportuno añadir unos breves comentarios -o marginalia, como diría Poe- en una tercera parte titulada: Consideraciones, que se acompaña de un anexo que contiene el texto del Proyecto para su verdadero escrutinio por el público interesado. Finalmente, se anhela que este pequeño aporte permita que los operadores de justicia se acerquen con mayor claridad en los intrincados recovecos en que se ha transformado nuestro envejecido y olvidado Derecho de Familia. Available in PDF, EPUB and Kindle. Book excerpt: A theme that has persisted throughout the history of American corrections is that efforts should be made to reform offenders. In particular, at the beginning of the 1900s, the rehabilitative ideal was enthusiastically trumpeted and helped to direct the renovation of the correctional system (e.g., implementation of indeterminate sentencing, parole, probation, a separate juvenile justice system). For the next seven decades, offender treatment reigned as the dominant correctional philosophy. Then, in the early 1970s, rehabilitation suffered a precipitous reversal of fortune. The larger disruptions in American society in this era prompted a general critique of the “state run” criminal justice system. Rehabilitation was blamed by liberals for allowing the state to act coercively against offenders, and was blamed by conservatives for allowing the state to act leniently toward offenders. In this context, the death knell of rehabilitation was seemingly sounded by Robert Martinson's (1974b) influential “nothing works” essay, which reported that few treatment programs reduced recidivism. This review of evaluation studies gave legitimacy to the antitreatment sentiments of the day; it ostensibly “proved” what everyone “already knew”: Rehabilitation did not work. In the subsequent quarter century, a growing revisionist movement has questioned Martinson's portrayal of the empirical status of the effectiveness of treatment interventions. Through painstaking literature reviews, these revisionist scholars have shown that many correctional treatment programs are effective in decreasing recidivism. More recently, they have undertaken more sophisticated quantitative syntheses of an increasing body of evaluation studies through a technique called “meta-analysis.” These meta-analyses reveal that across evaluation studies, the recidivism rate is, on average, 10 percentage points lower for the treatment group than for the control group. However, this research has also suggested that some correctional interventions have no effect on offender criminality (e.g., punishment-oriented programs), while others achieve substantial reductions in recidivism (i.e., approximately 25 percent). This variation in program success has led to a search for those “principles” that distinguish effective treatment interventions from ineffective ones. There is theoretical and empirical support for the conclusion that the rehabilitation programs that achieve the greatest reductions in recidivism use cognitive-behavioral treatments, target known predictors of crime for change, and intervene mainly with high-risk offenders. “Multisystemic treatment” is a concrete example of an effective program that largely conforms to these principles. In the time ahead, it would appear prudent that correctional policy and practice be “evidence based.” Knowledgeable about the extant research, policymakers would embrace the view that rehabilitation programs, informed by the principles of effective intervention, can “work” to reduce recidivism and thus can help foster public safety. By reaffirming rehabilitation, they would also be pursuing a policy that is consistent with public opinion research showing that Americans continue to believe that offender treatment should be an integral goal of the correctional system.

Samuel Ramos’s avowed purpose is to assist in the spiritual reform of Mexico by developing a theory that might explain the real character of Mexican culture. His approach is not flattering to his fellow citizens. After an analysis of the historical forces that have molded the national psychology, Ramos concludes that the Mexican sense of inferiority is the basis for most of the Mexican’s spiritual troubles and for the shortcomings of the Mexican culture. Ramos subscribes to neither of the two major opposing schools of thought as to what norms should direct the development of Mexican culture. He agrees neither with the nationalists, who urge a deliberate search for originality and isolation from universal culture, nor with the “Europeanizers,” who advocate abandonment of the life around them and a withdrawal into the modes of foreign cultures. Ramos thinks that Mexico’s hope lies in a respect for the good in native elements and a careful selection of those foreign elements that are appropriate to Mexican life. Such a sensible choice of foreign elements will result not in imitation, but in assimilation. Combined with the nurturing of desirable native elements, it will result in an independent cultural unit, “a new branch grafted onto world culture.” Ramos finds in Mexico no lack of intelligence or vitality: “It needs only to learn.” And he believes that the future is Mexico’s, that favorable destinies await a Mexico striving for the elevation of humanity, for the betterment of life, for the development of all the national capacities.
