[…] los fallos judiciales pueden no llevar ninguna huella visible del pensamiento económico, pero serán decisiones en clientes si su precedente […] se basó implícita o explícitamente en un deseo de mejorar la e ciencia. Así pues, el derecho puede ser el cliente, aunque solo una pequeña minoría de casos [judiciales] se ocupe de la eficiencia”. (Richard Posner, 1993). “El análisis económico del derecho supone que las personas poseen creencias correctas y que escogen racionalmente. ¿Pero qué pasa si no es así? ¿Cómo debería cambiar el análisis económico del derecho?”. (Richard Thaler, 2016). Estas tres citas ilustran diferentes etapas en los debates sobre la definición, función y evolución del análisis económico del derecho (AED) durante las últimas cuatro décadas. También evidencian que no existe una única forma de “hacer” AED. Así, este libro se inscribe en este contexto, y en la primera parte intenta responder críticamente a preguntas como: ¿Cuál es la definición y los fundamentos del AED? ¿Cuáles son las diferencias con el derecho económico? ¿Cómo puede la economía justificar e imponer límites a la intervención estatal cuando se materializa en normas jurídicas? ¿Qué es la economía en el derecho de propiedad y cuáles son sus diferencias con el “derecho” del derecho de propiedad? Luego, en la segunda parte, el texto describe, analiza y establece un diálogo entre cuatro de las principales escuelas de análisis del derecho: 1) la escuela neoclásica del AED, 2) el enfoque de la elección pública (Public Choice), 3) la economía austriaca y, por último, 4) el enfoque del Behavioral, Law & Economics

Bundled loyalty discounts, in which customers receive a price break on the monopoly good in exchange for making all purchases from the monopolist, have ambiguous welfare effects. To analyze such discounts as predatory pricing is incorrect. In some settings, they act as tie-in sales. Existing tests for whether such discounts violate Section 2 of the Sherman Act do not track changes in consumer surplus or total surplus. We present a new test and use it in an illustrative example based on SmithKline that assumes the "tied" market is a homogeneous good. If the tied market is characterized by Hotelling competition, bundling by the monopolist causes the rival firm to reduce its price. In numerical examples, we find that this can deter entry or induce exit.

Book excerpt: From the earliest times, people have striven to turn their houses into homes through the use of decoration and furnishings, stimulating in turn a major commercial sector dedicated to offering the products and services essential to feed the ever-changing dictates of domestic fashion. Whilst there is plentiful evidence to show that these phenomena can be traced to medieval times, it is arguable that the eighteenth century witnessed the birth of a widespread and sophisticated consumer society. With a comparatively wealthy and socially mobile society, eighteenth-century Britain proved to be a fertile ground for ideas of home improvement and beautification, which were to persist to the present day. Turning Houses into Homes not only maps the history, changes, development and structure of the retail furnishing industry in Britain over three centuries, but also examines the relationships between the retailer and the consumer, looking at how retailers helped stimulate and shape the demand of their customers. Whilst work has been done on specific aspects of the home, very little has been written on the interaction between the retailer and consumer, and the pressures brought to bear on them by issues such as gender, education, status, symbolism, taste, decoration, hygiene, comfort and entertainment. As such, this book offers a valuable conjunction of retail history and consumption practices, which are examined through a multi-disciplinary approach to explore both their intimate connections and their wider roles in society.

Book excerpt: The poverty-reducing effects of remittances have been well-documented, however, their effects on inequality are less clear. This paper examines the impact of remittances on inequality in Mexico using household-level information on the receiving side. It hopes to speak to their insurance role by examining how remittances are affected by domestic and external crises: the 1994 Mexican Peso crisis and the Global Financial Crisis. We find that remittances lower inequality, and that they become more pro-poor over time as migration opportunities become more widespread. This also strengthens their insurance effects, mitigating some of the negative impact of shocks on the poorest.

However, while the region is broadly at par with its peers on financial inclusion of firms, household inclusion lags behind. Nonetheless, there is substantial heterogeneity across LAC countries. Reducing borrowing costs and strengthening further the regulatory environment, while taking steps to protect efficiency and stability of the financial system, could help close financial inclusion gaps. Reducing financial participation and monitoring costs and relaxing collateral constraints will help spur growth and reduce inequality though trade-offs are likely, as illustrated in the case of Guatemala, El Salvador, and Peru.

Book excerpt: This paper examines the state of financial development in the Latin America and Caribbean (LAC) region as well as potential growth and stability implications from further development. The analysis suggests that access to financial institutions has expanded notably in the past decade, and the region compares favorably with other emerging market regions on this dimension. The region, however, continues to lag behind peers on broader financial development, especially with respect to markets, though there is substantial heterogeneity across countries. Financial systems in many LAC countries are also underdeveloped relative to their macroeconomic fundamentals. Further financial development could convey net benefits to the region, provided there is adequate regulatory oversight to prevent excesses.
