Book excerpt: "The People's Republic of China (PRC) is developing space technologies, in part, to deter and compel the United States from taking actions that Beijing deems counter to its national security interests. PRC coercive space efforts are intended to achieve effects in, from, and to space. People's Liberation Army (PLA) researchers have assessed space capabilities as playing an outsized role in strategic coercive efforts. In comparison to nuclear capabilities, PLA researchers perceive space capabilities as a more usable and effective method of influencing an adversary. PRC writings on space deterrence and compellence highlight several factors that may complicate the ability of the United States to deter the PRC from taking military action. The perception that space underpins U.S. military superiority may make U.S. space assets an irresistible target for PLA planners. The perception on the part of some PLA researchers that space is an offense-dominant domain, and that coercive efforts and conflicts may begin in space, also suggests the PLA may place a high priority on threatening U.S. space assets. Considering the role of deterrence and compellence in PLA space operations may also provide insight into the motivations for PLA demonstrations of space power, such as the 2007 test that destroyed a satellite and the 2022 towing of a satellite to a graveyard orbit by the Shijian-21 satellite. As part of the PRC's active defense strategy, PRC researchers state that coercive activities can occur in both peacetime and wartime and can involve demonstrations of space power, tests of space capabilities, and the use of force. As a result, PRC development, testing, and use of space and counterspace capabilities may be intended to demonstrate the capability and resolve to attack U.S. satellites, raise doubts about the U.S. nuclear deterrent, and threaten the U.S. homeland with attack. Which kinds of behavior are justifiably prohibited, which kinds justifiably required? What uses of law are not defensible? How can the legitimacy or the ille gitimacy of various uses of law be explained or accounted for? These are questions the answering of which involves one in many issues of moral principle, for the answers require that one adopt positions - even if only implicitly - on further questions of what kinds of actions or policies are morally or ethically acceptable. The present work, aimed at questions of these kinds, is thus a study in the ethical evaluation of major uses of legal coercion. It is an attempt to provide a framework within which many questions about the proper uses of law may be fruitfully discussed. The framework, if successful, can be used by anyone asking questions about the defensibility of particular or general uses of law, whether from the perspective of someone considering whether to bring about some new legal provision, from the perspective of someone concerned to evaluate an eXisting provision, or from that of someone concerned more abstractly with questions about the appropriate substance of an ideal legal system. In addressing these and associated issues, I shall be exploring the extent to which an ethics based on respect for persons and their autonomy can handle satisfactorily the problems arising here.

This study reviews deterrence literature and nine case studies of coercion to develop recommendations for how the United States and its allies and partners could counter gray zone activity.

On the one hand, Americans don't want "big government" meddling in their lives; on the other hand, they have repeatedly enlisted governmental help to impose their views regarding marriage, abortion, religion, and schooling on their neighbors. These contradictory stances on the role of public power have paralyzed policymaking and generated rancorous disputes about government’s legitimate scope. How did we reach this political impasse? Historian Gary Gerstle, looking at two hundred years of U.S. history, argues that the roots of the current crisis lie in two contrasting theories of power that the Framers inscribed in the Constitution. One theory shaped the federal government, setting limits on its power in order to protect personal liberty. Another theory molded the states, authorizing them to go to extraordinary lengths, even to the point of violating individual rights, to advance the "good and welfare of the commonwealth." The Framers believed these theories could coexist comfortably, but conflict between the two has largely defined American history. Gerstle shows how national political leaders improvised brilliantly to stretch the power of the federal government beyond where it was meant to go—but at the cost of giving private interests and state governments too much sway over public policy. The states could be innovative, too. More impressive was their staying power. Only in the 1960s did the federal government, impelled by the Cold War and civil rights movement, definitively assert its primacy. But as the power of the central state expanded, its constitutional authority did not keep pace. Conservatives rebelled, making the battle over government’s proper dominion the defining issue of our time. From the Revolution to the Tea Party, and the Bill of Rights to the national security state, Liberty and Coercion is a revelatory account of the making and unmaking of government in America.

As a result of the fast pace of technological developments in air and space activities and the massive increases in air transportation , satellite communications and space exploration, the need for scholars and practitioners to sharpen their appreciation of the legal and political issues becomes crucial. This book will focus primarily on the issues of sovereignty jurisdiction and control in airspace and outer space and their effects on public and private activities, but it will also look at related issues pertaining to the Seas and Antarctica. Commercial exploitation, resource control and the international regime regulating contractual obligations in relation to transportation of goods and services over all forms of territory will be examined to the extent that they are necessary to explain jurisdictional rights and duties over territory. Older problems of international law such as crimes in the air and airspace trespass are treated along with newer developments such as space tourism as well as growing demand for private ownership and involvement in outer space exploitation. The book goes on to consider the distinction between airspace and outer space and puts forward legal criteria which would allow for the resolution of the spatial delimitation dispute. These criteria would determine where in spatial terms the exclusive sovereignty of airspace ends and where outer space – the province of all mankind – begins, and contribute to the jurisprudence of territorial sovereignty and jurisdiction.
