Book excerpt: Lo studio del diritto penitenziario, rappresenta il terreno privilegiato per una riflessione sul significato che assume attualmente la sanzione penale. La rapida evoluzione che ha caratterizzato la disciplina normativa degli ultimi trent’anni in materia di misure alternative alla detenzione, sembra aver condotto a una realtà dissociata tra la fase della commisurazione e/o irrogazione della pena e quella della esecuzione della sentenza di condanna. Un malinteso senso di premialità, fondato sulle possibilità di accesso ad un’ampia fascia di benefici penitenziari, ha indotto a ritenere che, se nella fase della commisurazione della pena lo Stato manifesta appieno la sua forza intimidativa, nella successiva fase di attuazione della sanzione si determina un dissolvimento delle aspettative punitive, attraverso l’applicazione generalizzata dei numerosi istituti di favore. Il tutto è stato poi ulteriormente compromesso dal ricorso che il legislatore repubblicano, sulla consolidata esperienza dello Stato liberale, ha sovente fatto ai provvedimenti di clemenza generalizzati che, oltre a sfoltire il numero dei detenuti negli istituti penitenziari, ha finito per compromettere il senso di effettività della pena. La ricaduta di tali premesse sull’assetto della giurisdizione si rivela peraltro quanto mai significativa. La presenza della Magistratura di Sorveglianza, che vedeva i suoi precorsi nell’organo amministrativo dell’Ufficio di sorveglianza, è il segno di una precisa svolta di valorizzazione dei canoni costituzionali della pena che indica continuità tra la fase dell’accertamento della responsabilità, con tutte le implicazioni di tipo prognostico ed individualizzante, e quella dell’applicazione in concreto della sanzione penale portata dal titolo esecutivo. Anche in questo ambito, peraltro, devono essere confermate le esigenze poste dal principio del contraddittorio e sancite dall’art. 111 della Carta costituzionale. I diversi progetti di riforma del codice penale, nella parte relativa al catalogo sanzionatorio, offrono ampio spazio per un recupero di centralità e di legalità della pena, recependo in un ampio ventaglio di sanzioni penali, la gran parte delle misure alternative alla detenzione varate nell’ambito della legislazione penitenziaria a partire dalla legge 26 luglio 1975, n. 354 e soprattutto con la successiva legge “Gozzini” del 1° ottobre 1986, n. 663 1. Un manuale di diritto penitenziario, oltre agli evidenti scopi di tipo didattico, non può non offrire spunti di seria riflessione sui compiti di una democrazia moderna, chiamata ad elaborare un giusto sistema di equilibri tra sicurezza dei cittadini, afflittività della sanzione penale e prospettive di integrazione sociale del condannato. Questo sembra il profilo più moderno ed interessante del volume che rappresenta un contributo significativo all’elaborazione di tematiche che, per i caratteri e le finalità della pena, sono sempre attuali e presenti all’attenzione del legislatore.

Book excerpt: From the tone of the report by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Re search, one might conclude that the whole-brain-oriented definition of death is now firmly established as an enduring element of public policy. In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.
