Book The Multinational Enterprise and Legal Control

Download or read book The Multinational Enterprise and Legal Control written by Cynthia Day Wallace and published by Martinus Nijhoff Publishers. This book was released on 2002-04-02 with total page 1364 pages. Available in PDF, EPUB and Kindle. Book excerpt: This long-awaited new book from Cynthia Day Wallace picks up the thread of her best-selling "Legal Control of the Multinational Enterprise: National Regulatory Techniques and the Prospects for International Controls," In the present work she applies herself to legal and pragmatic aspects of control surrounding MNE operations. The primary focus is on legal and administrative techniques and measures practised by host states to control - transparently or less so - foreign MNE activity within their territories, or even extraterritorially when effects are felt within national boundaries. The primary geographic focus is the six most investment-intensive industrialized states (namely, Canada, France, Germany, Japan, the United States and the United Kingdom). At the same time an important message of the present study is precisely the implication for the developing countries as well as for the emerging market economies of central and eastern Europe - and even Asian nations besides Japan, because it is the sharing of this very 'experience of years' that can best serve to facilitate a fuller participation on the part of the up-and-coming economies in the same global market place.

Book Capital Account Liberalization

Download or read book Capital Account Liberalization written by Peter Blair Henry and published by . This book was released on 2006 with total page 82 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Writings on the macroeconomic impact of capital account liberalization find few, if any, robust effects of liberalization on real variables. In contrast to the prevailing wisdom, I argue that the textbook theory of liberalization holds up quite well to a critical reading of this literature. The lion's share of papers that find no effect of liberalization on real variables tell us nothing about the empirical validity of the theory, because they do not really test it. This paper explains why it is that most studies do not really address the theory they set out to test. It also discusses what is necessary to test the theory and examines papers that have done so. Studies that actually test the theory show that liberalization has significant effects on the cost of capital, investment, and economic growth"--National Bureau of Economic Research web site.

Book International Trade and Economic Law and the European Union

Download or read book International Trade and Economic Law and the European Union written by Sara Dillon and published by Bloomsbury Publishing. This book was released on 2002-09-09 with total page 412 pages. Available in PDF, EPUB and Kindle. Book excerpt: This timely book explores the developing nature of international trade law, with particular emphasis on World Trade Organization law and its effects within the European Union. In the aftermath of the Seattle upheaval, vital questions are being raised as to the future course of global economic law; its overall legitimacy, implications for democracy, for national social and environmental policies, and for the well being of the world's people. This highly technical subject is rigorously analysed, yet the main legal developments and the major trade disputes are discussed in an accessible narrative style. The first section covers the common historical roots of the GATT and the EC, systems of integration that were part of an idealistic post-war heritage. The book goes on to demonstrate the idiosyncratic development of GATT law, leading to the launch of the WTO in 1995 and the controversial Uruguay Round Agreements which represented the beginning of an enormous proliferation of causes of action and a greatly enhanced legalism for the global trading system.

For citizens it means the ability to perform many operations abroad, as diverse as opening bank accounts, buying shares in non-domestic companies, investing where the best return is, and purchasing real estate. For companies it principally means being able to invest in and own other European companies and take an active part in their management. With all its benefits, the free movement of capital brings with it an array of thorny issues. Book Stocks for All People s Capitalism in the Twenty First Century

Download or read book Stocks for All People s Capitalism in the Twenty First Century written by Petri Mäntysaari and published by Walter de Gruyter GmbH & Co KG. This book was released on 2021-12-31 with total page 1037 pages. Available in PDF, EPUB and Kindle. Book excerpt: Public stock markets are too small. This book is an effort to rescue public stock markets in the EU and the US. There should be more companies with publicly-traded shares and more direct share ownership. Anchored in a broad historical study of the regulation of stock markets and companies in Europe and the US, the book proposes ways to create a new regulatory regime designed to help firms and facilitate people’s capitalism. Through its comparative and historical study of regulation and legal practices, the book helps to understand the evolution of public stock markets from the nineteenth century to the present day. The book identifies design principles that reflect prior regulation. While continental European company law has produced many enduring design principles, the recent regulation of stock markets in the EU and the US has failed to serve the needs of both firms and retail investors. The book therefore proposes a new set of design principles to serve contemporary societal needs.
