The Indo-Pacific waters and, therein, the South China Sea (SCS) qualifies as the “center of gravity in global geopolitics”. Foremost due to its attributes as a disputed area of sovereignty/dominion, its rich flow/stock resources, and crucial sealines of communication for world trade. To peacefully manage SCS’s MARSAF and MARSEC , the literature suggests that over the past political/military leaders have built a profound framework of “Maritime Confidence-building Measures” (MCBM) to improve “awareness” and “governance” on a “strategic, operational and tactical” level. In particular, through the collaborative “security communities” concept (e.g., ASEAN, ADMM, ADMM Plus, WPNS, MMCA) and “legally binding and nonbinding instruments” (e.g., COLREG, UNCLOS, CUES). In contrast, from 2010 to 2020, increased hegemonic Chinese military and grey zone activities as well as Vietnamese/Indonesian/Philippine/Thai (re)actions led to 73 deliberate ship rammings/ chasings/harassings among the parties. Between 2016 and 2018, China conducted 18 risky close-distance maneuvers toward U.S. naval vessels in the Pacific. These numbers suggest a practical discrepancy, “compliance” shortfall, and “unsafe” behavior by the signatories (in particular by China), raising initial doubts about the utility of the MCBM framework to achieve its safety/security purposes. To scope the essay to a workable set of SCS related research questions, it will examine to which extent the nonbinding CUES ('Independent Variable') did/will prove useful: a) to increase MARSAF ('Antecedent Condition' on tactical and operational levels), b) to (then) increase MARSEC ('Dependent Variable' on a strategic level)?

This 'soft law' or 'informal law' is now prolific in ocean governance, and so it is time to consider its significance for the law of the sea. Informal lawmaking is examined in relation to ocean resources, maritime security, shipping and navigation, and the marine environment. The growing reliance on informal agreements to fill legal gaps provides quick responses to pressing matters. These instruments lower the risk of the unintended use of force by introducing elements of reassurance into an environment characterized by conflicting strategic objectives and fundamental differences of interest. The report argues that the same characteristics apply to NATO-Russian relations in the Euro-Atlantic area. The adoption of a code for unplanned encounters there would not directly influence conflicts of interest, but it could reintroduce positive aspects to relations and reduce the risk that unintended incidents result in the use of force.

To concentrate only on geopolitical competition and regional 'hot spots' will exaggerate, if not misrepresent East Asia as a Hobbesian world. Nevertheless, geopolitical competition cannot be ignored because a failure of the balance of power and deterrence between China and the United States (and its allies) will destabilise the region. There are four 'vectors' in the geopolitics of East Asia: China rising, the United States 'rebalancing' to this region, Japan 'normalising' as a nation-state and ASEAN emerging as a regional community. The interplay of these four 'vectors' will set the trajectory of geopolitics in East Asia. Another focus of this volume is on the politics of identity. The distinctiveness, character and flavour of a group, real or imagined, can be 'cool'. 'Cool' as in being charming and appealing transcends national boundaries. Plurality and diversity of identities and cultures in East Asia can be a celebration of life and humanity. However, xenophobic identities, often based on exclusive race, language, religion and hegemony, and its subsequent politicisation can rend a nation apart. Indeed, the affirmation of one's identity may be at the expense or denial of the identity of 'the other'. Similarly, the assertion and the intricacy of identity and nationalism in East Asia can also be problematic. However, a person or group can have multiple and different scales of identities. Indeed, identities can be fluid and situational.
