In the name of Almighty God: The United States of America and the United Mexican States, animated by a sincere desire to put an end to the calamities of the war which unhappily exists between the two republics, and to establish upon a solid basis relations of peace and friendship, which shall confer reciprocal benefits upon the citizens of both, and assure the concord, harmony and mutual confidence wherein the two people should live, as good neighbors, have for that purpose appointed their respective plenipotentiaries, that is to say, the President of the United States has appointed Nicholas P. Book excerpt: Excerpt from Claims Against Mexico The misunderstanding between Mexico and other nations in the matter of claims for losses sustained during the Mex ican revolutions Since 1910 has been intensified by the failure of many statesmen, politicians and publicists, particularly in Mexico and the United States, to reach conclusions in accord ance with well-settled principles of international law and sound diplomatic practice. When occasion has arisen for a determination of policy, tragedy has several times threatened because eloquence displaced clear thinking and judicial deliberation. Many estimates of the damages sustained by aliens in Mexico have been made, but these estimates at best are but guesses. Strange though it may seem, there has heretofore been no attempt to collect the principles of international law applicable particularly to the Mexican situation, and to view the issue of responsibility and liability, and to measure the recoverable quantum of damage, with such a codification as a foundation. In the preparation of this volume there has been little occasion for originality. Practically the entire subject is governed and controlled by diplomatic precedents readily available to the student and discussed in the works of author ities. This treatise is not, therefore, a composition, but a compilation. Selection has been made, wherever possible, of international precedents covering controversies to which Mexico has been a party, and because Of the peculiar position of the United States under the Monroe Doctrine, particularly of precedents between the United States and Mexico further more, it has not been possible within a volume of this size to exhaust the subject or even to indicate the law applicable to every possible type of Claim. Book excerpt: Excerpt from Memoranda of Four Claims Against Mexico: Which Were Submitted to the Late Board and Rejected The schooner Rebecca, with a lawful cargo of goods, sailed on the 4th of April, 1822, from New Orleans, on a trading voyage to Mexico. The property was owned by the claimant, James W. Zacharie; though at the time he had a partner in business with him, named Samuel H. Turner. The concern became embarrassed in consequence of this and other heavy losses, and thereupon closed up the concern, Mr. Zacharie agreeing to pay all the debts from private means; and in consideration thereof, all the assets and claims were assigned to him; and, having paid the debts, became the sole owner of all the effects, and he is the only person who now has, or since the time of said agreement has had, any interest in this claim. The schooner touched, by permission of the authorities there, at old Tampico, then called Pueblo Viejo, and landed a part or all of the cargo. Some articles to a small amount were sold; the articles not sold were reshipped, and the vessel regularly cleared for a further voyage. All the necessary papers for the purpose were obtained from the Mexican custom-house for that purpose, and she left the port, but was detained at the bar. While there, the judge, military commander, and collector, conceived the plan of appropriating the property to themselves; and, under the pretence that they had information which excited a suspicion that it was intended to smuggle the cargo into Mexico, they seized her and her cargo, and by an armed force took them back to Tampico. In consequence of this illegal and outrageous proceeding, the claimant lost not only the cargo, but the vessel, and now presents bis claim for compensation. The facts in this case are not numerous or complicated; and it is not apprehended that the Board will hesitate in coming to the conclusion that the claim is just and well sustained by the evidence. The vessel and cargo, for which compensation is now sought, were owned by Messrs. Zacharie & Turner, merchants of New Orleans, and were sent out to Mexico in 1822, and seized by the Mexican authorities at or near Tampico. Vigorous efforts were made at the time to get possession of the property, and, after its sale, of the avails, but they were unsuccessful. For either to yield, would be to submit, without a struggle, to all the consequences of an unsuccessful war, and to abandon every ground which has been deliberately and publicly as sumed. The American government cannot retrace its steps. It cannot annul the compact by which Texas has become bone of our bone, and flesh of our flesh. It cannot admit that its conduct merits the harsh epithets which have been applied to it by Mexico and her friends. As little can she retract what she has so repeatedly urged on the subject of the claims of her citizens for remuneration and indemnification. She has proclaimed that, in the perpetration of the outrages of which she com plains, Mexico has violated our just rights, and that it is the paramount duty of the government to afford ample protection to her citizens, and to enforce, if necessary, with all the power of the nation, full compensation for the wrongs they have sustained from a foreign power. She has sanc tified and solemnized the obligation growing out of the relation of govern ment and citizen, by the most deliberate assurances that this obligation is recognized, and the most distinct pledges that his duty shall be fulfilled. In this posture of things, it seems vain to expect that specific relations can long subsist between the two nations. Each professes to have grounds of complaint against the other, which it asserts to be just and reasonable; and each has pledged itself to maintain its rights at every hazard. Temporary causes may intervene, and prevent an immediate resort to arms by either power; but the causes of war cannot be removed, and they must continue to increase in number and to augment in strength, till they bear down every barrier which wisdom or policy may interpose to prevent the final catastrophe. Book excerpt: Excerpt from Claims as a Cause of the Mexican War: A Thesis Submitted to New York, University in Partial Fulfillment, of the Requirements for the Degree of Doctor of Philosophy After Mexico won her independence from Spain in 1821, there followed a period of thirty or forty years in which both the society and government of that country underwent profound changes. The conservatives completely dominated by the clergy were bent upon retaining the old monarchy. The liberals were equally strong in their desire to establish republican institutions. The struggle between the old order and the new kept Mexico in almost constant revolution from 1821 to 1855. In this period, the form of government was changed eight times and the country was ruled by thirty-five different administrations. Romero, one of the recent ministers of Mexico to this country, says that conditions during this time were very similar to those existing in European countries during the feudal regime. The clergy, he maintains, were really feudal barons monopolizing the wealth and education of the country and exerting a powerful influence over the minds of the people. Webster in 1846 gave it as his opinion that Mexico had had one of the most irregular and worst governments that had ever existed on earth. Such conditions inevitably led to many difficulties between Mexico and the foreign nations whose citizens resided in that country or had business interests there. Many Americans were engaged in Mexican trade, and they soon made numerous complaints because of confiscation of property and personal mistreatment. For twenty years prior to the Mexican War these complaints constituted one of the most important subjects of controversy between the two nations. It was impossible to keep them from being blended with the other questions under diplomatic discussion. This fact has led to much confusion of thought regarding their true significance in the relations between the two countries. Every president of the United States from Jackson to Buchanan, with the possible exception of Van Buren, ardently desired to secure the two Mexican provinces of Texas and California. J, Res, 80& Gt Sir: The commission appointed by paragraph 27, Special Orders, No.205, War Department, August 30, 1912, has the honor to submit herewith its report, as required under the terms of joint resolution No.48, approved August 9, 1912, for submission to the Congress through the Secretary of War. For reasons of convenience and completeness the resolution and order under which the commission acted are quoted in full: Joint Resolution Directing the Secretary of War to investigate the claims of American citizens for damages suffered within American territory and growing out of the late insurrection in Mexico. Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War be, and he is hereby, authorized and directed to make, or cause to be made under his direction, a full and thorough investigation of each and all claims of American citizens and of persons domiciled in the United States which may be called to his attention by claimants or their attorneys for damages for injuries to their persons or property, received by them or by those of whom claimants may be the legal representatives, within the boundaries of the United States, by means of gunshot wounds or otherwise inflicted by Mexican Federal or insurgent troops during the kite insurrection in Mexico in the year nineteen hundred and eleven. For the purpose of such investigation the Secretary of War is authorized to appoint a commission of three officers of the Army, one of whom shall be an Inspector general. Such commission shall have authority to subpoena witnesses, administer oaths, and to take evidence on oath relating to any such claim and to compel the attendance of witnesses and the production of books and papers In any such proceeding by application to the district court of the United States for the district within which any session of the commission is held, which court is hereby empowered and directed to make all orders and issue all processes necessary for that purpose, and said commission shall have all the powers conferred by law upon inspectors general of the United States Army in the performance of their duties. Such commission shall report to Congress, through the Secretary of War, as soon as practicable, its findings of fact upon each and all the claims presented to it and its conclusion as to the justice and equity thereof and as to the proper amount of compensation or indemnity thereupon. It is to be observed that the claims of the individuals interested against the Mexican Government are not created by the Conventions. All that the Conventions do is to create an obligation as between the two Governments for the payment in the prescribed manner. And it is, we think, competent for the Governments concerned to put an end to this international agreement. Book excerpt: Excerpt from Recollections of Mexico I Have yielded with a good deal of reluctance to the importunities of many of my friends in consenting to devote the little leisure which is left me from professional and other avocations, to writing the following pages. No thought of such a thing ever occurred to me during my residence in Mexico, or I should have supplied myself, as I had abundant means of doing, with the materials for such a work. The book, therefore, will be found to contain just what its title imports - "Recollections and Desultory Dissertations." The reader must not expect the life and freshness of a finished picture, but mere sketches and outlines - nor that minute exactness of detail on many subjects which may be desirable, although I believe that the sketches will be found to be generally accurate; I can say in the words of an affidavit to an answer in chancery, "that the facts stated as of my own knowledge are true, and those stated on the information of others I believe to be true." I am not sure, however, that a description of the customs, scenes, and peculiarities of a country is not generally the better for being written a year or two after the writer has left it. The want of exactness in minute particulars is compensated by the absence of a sometimes wearisome tediousness of detail, and often of circumstances of interest only to the writer. And it is perhaps also true that the general remembrance - a sort of skeleton map which is left on the mind of the writer will give to the reader a more accurate coup d'aeil of the country and all its peculiarities, physical and social, than a more minute description. Before I went to Mexico I sought in vain for some work which would give me some idea of the society, manners, and customs of that unique, and, in a great degree, primitive people.
