Book Civil Church Law Classic Reprint

Download or read book Civil Church Law Classic Reprint written by George James Bales and published by . This book was released on 2015-07-13 with total page 86 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Civil Church Law Note. - Under the general title of Civil Church Law it is purposed to edit a series of digests presenting the statute law affecting religious organizations as it is being developed in the American commonwealths. Such law is not now easily accessible to the great body of church people, yet with the rapid development of church as one of the great institutions of American society there is more and more use for it. Again, the time has passed when even the chief features of the civil church law of all the commonwealths could with convenience be presented in a single volume, and those bearing church responsibilities generally need to know only the law directly defining their duties and rights. American statute legislation relating to ecclesiastical organization is developing rapidly. It is evident that we are in the midst of a general movement for the broader introduction of purely ecclesiastical elements into the civil law, creating not indeed a civil establishment of religion, but more and more of a legal establishment of church. In order to set forth this body of law as it develops, in the form best adapted to serve the interests of the whole body of church people, the plan of a series of State digests has been adopted. The type for these digests will be kept standing, and the changes in the law of each State will be presented annually. To extend the benefit of this watch on legislation for churches to the churches themselves it has been arranged that subscribers to any State digest shall receive free of charge for a period of three years after their subscription copy of all further legislation affecting religious organizations. If, however, a general revision of the law should be effected during such a period, the editor reserves the right to bring out another edition. Book The Clergy Sex Abuse Crisis and the Legal Responses

Download or read book The Clergy Sex Abuse Crisis and the Legal Responses written by James T. O'Reilly and published by Oxford University Press. This book was released on 2014-09-09 with total page 474 pages. Available in PDF, EPUB and Kindle. Book excerpt: The sexual abuse of children and teens by rogue priests in the U.S. Catholic Church is a heinous crime, and those who pray for a religious community as its ministers, priests and rabbis should never tolerate those who prey on that community. The legal disputes of recent years have produced many scandalous headlines and fuelled public discussion about the sexual abuse crisis within the clergy, a crisis that has cost the U.S. Catholic Church over $3 billion. In The Clergy Sex Abuse Crisis and the Legal Responses, two eminent experts, James O'Reilly and Margaret Chalmers, draw on the lessons of recent years to discern the interplay between civil damages law and global church-based canon law. In some countries civil and canon law, although autonomous systems of law, both form part of the church's legal duties. In the United States, freedom of religion issues have complicated how the state adjudicates both cases of abuse and who can be held responsible for clerical oversight. This book examines questions of civil and criminal liability, issues of respondeat superior and oversight, issues with statutes of limitations and dealing with allegations that occurred decades ago, and how the Church's internal judicial processes interact or clash with the civil pursuit of these cases.

Book Law and Religion

  • Pages : 760 pages

Download or read book Law and Religion written by Leslie Griffin and published by . This book was released on 2007 with total page 760 pages. Available in PDF, EPUB and Kindle. Book excerpt: This new casebook fills the need for an interdisciplinary approach to law and religion. It combines a thorough academic review of religion with broad legal coverage that extends beyond the Supreme Court's First Amendment cases to other federal and state cases about a range of religious topics. In addition to chapters on Free Exercise and Establishment, the book's topics include: Individual Conscience and the State (examining conscientious objection and civil disobedience in the military, medical and legal professions); Religion and Politics; Teaching About Religion and Science (including materials about religious studies and theology as well as evolution, creation-science and intelligent design); Comparative Religious Freedom (studying the protection of religious freedom in international law as well as the recognition of religious freedom by the world¿s religious traditions); and Church Autonomy (legal disputes about torts, property and employment law). This casebook's distinguishing feature is that it addresses religion as well as law, giving students more resources to learn about the world¿s religious traditions. Just as law and economics includes economics, and law and literature studies literature, this casebook takes a similar interdisciplinary approach to show how a thorough examination of religion is vital to understanding how courts confront the wide array of issues associated with religion.

Download or read book The Fight for Marriage written by Phillip F. Cramer and published by Abingdon Press. This book was released on 2018-03-26 with total page 126 pages. Available in PDF, EPUB and Kindle. Book excerpt: For leaders in governments and in churches, marriage equality is the most contentious civil-rights dispute in the 21st century. During an era where nearly half of all marriages end in divorce, same-gender couples now have the federal civil right to marry, too. At a time when 62 percent of Americans approve of same-gender marriage, according to June 2017 Pew Research, churches are having to come to terms with whether to recognize and affirm these faithful partnerships as sacred covenants. Attorneys Harbison and Cramer, faithful and active members of a United Methodist congregation, brought one of the cases to the US Supreme Court, which resulted in the 2015 landmark decision that permits persons of the same gender to marry. They bring a unique legal and cultural perspective to the controversy. For the three couples Harbison and Cramer represented, marriage is not an "issue" to be resolved. Marriage is rather a sign for these couples of their faithful promise to love each other until they depart this life. "Each couple married for several reasons, including their commitment to love and support one another, to demonstrate their mutual commitment to their family, friends, and colleagues, and to show others that they should be treated as a family. They also married to make a legally binding mutual commitment, to join their resources together in a legal unit, and to be treated by others as a legal family unit, rather than as legally unrelated individuals. Finally, each couple married so that they could access the legal responsibilities of marriage to protect themselves and their families, just as heterosexual couples do." Aleta A. Trauger, Federal Judge With a first-hand account of the respectful courtroom drama concerning marriage in American communities and states, Harbison and Cramer show why states care about marriage, why the church got involved in marriage more than a thousand years after Jesus's earthly ministry, and how the church and the state function in partnership to foster the purposes and social benefits of marriage. From the Faultlines collection, resources intended to inform conversations around human sexuality and the church.
