Book The Cost of Counterterrorism

Download or read book The Cost of Counterterrorism written by Laura K. Donohue and published by Cambridge University Press. This book was released on 2008-04-14 with total page 512 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the aftermath of a terrorist attack political stakes are high: legislators fear being seen as lenient or indifferent and often grant the executive broader authorities without thorough debate. The judiciary's role, too, is restricted: constitutional structure and cultural norms narrow the courts' ability to check the executive at all but the margins. The dominant 'Security or Freedom' framework for evaluating counterterrorist law thus fails to capture an important characteristic: increased executive power that shifts the balance between branches of government. This book re-calculates the cost of counterterrorist law to the United Kingdom and the United States, arguing that the damage caused is significantly greater than first appears. Donohue warns that the proliferation of biological and nuclear materials, together with willingness on the part of extremists to sacrifice themselves, may drive each country to take increasingly drastic measures with a resultant shift in the basic structure of both states.

Book Anti Terrorism Law and Normalising Northern Ireland

Download or read book Anti Terrorism Law and Normalising Northern Ireland written by Jessie Blackbourn and published by Routledge. This book was released on 2014-08-07 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Northern Ireland peace process has been heralded by those involved as a successful example of transformation from a violent conflict to a peaceful society. This book examines the implementation of the Belfast Agreement in Northern Ireland, and evaluates whether its goal to establish a normal, peaceful society has been fully realised. Using the political and legal status of England, Scotland and Wales as a comparison, Jessie Blackbourn evaluates eight aspects of Northern Ireland which the Agreement aimed to normalise: the contested constitutional status of Northern Ireland, the devolution of power, decommissioning, the removal of emergency laws, demilitarisation, police reform, criminal justice reform, and paramilitary prisoners. The book highlights the historical context which gave rise to the need for a programme of normalisation within the Belfast Agreement with respect to these areas and assesses the extent to which that programme of normalisation has been successfully implemented. By evaluating the implementation of the Belfast Agreement, the book demonstrates the difficulties that transitional or post-conflict states face in attempting to wind back extraordinary counter-terrorism policies after periods of violence have been brought to an end. The book will be of great use to students and researchers concerned with the emergence, evolution and repeal of anti-terrorism laws, and anyone interested in the history of the conflict and peace process in Northern Ireland.

Book Labour and the Politics of Disloyalty in Belfast 1921 39

Download or read book Labour and the Politics of Disloyalty in Belfast 1921 39 written by Christopher J. V. Loughlin and published by Springer. This book was released on 2018-02-05 with total page 175 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides the first ‘history from below’ of the inter-war Belfast labour movement. It is a social history of the politics of Belfast labour and applies methodology from history, sociology and political science. Christopher J. V. Loughlin questions previous narratives that asserted the centrality of religion and sectarian conflict in the establishment of Northern Ireland. Labour and the Politics of Disloyalty in Belfast, 1921-39 suggests that political division and violence were key to the foundation and maintenance of the democratic ancien régime in Northern Ireland. It examines the relationship between Belfast Labour, sectarianism, electoral politics, security and industrial relations policy, and women’s politics in the city.

Book Irish Political Prisoners 1960 2000

Download or read book Irish Political Prisoners 1960 2000 written by Seán McConville and published by Routledge. This book was released on 2021-03-30 with total page 1168 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a comprehensive, detailed and humane account of the thousands who came into custody during the years of the Northern Ireland conflict and how they lived out the months, years and decades in Irish and English maximum security prisons. Erupting in 1969, the Northern Ireland troubles continued with terrible intensity until 1998. The most enduring civil conflict in Western Europe since the Second World War cost almost 4,000 lives, inflicted a vast toll of injuries and wrought much destruction. Based on extensive archival research and numerous interviews, this book covers the jurisdictions of Northern Ireland, the Republic of Ireland and England, providing an account of riots, escapes, strip and dirty protests and hunger strikes. It paints a picture of coming to terms with sentences, some of which lasted for two decades and more. Republicans and loyalists, male and female prisoners, officials and staff, families, supporters, clergy and politicians all played a part – and all were changed. The narrative includes some of the most remarkable events in prison history anywhere – mass breakouts, organised cell-fouling and prolonged nakedness, and hunger striking to the death; there are also accounts of the prisoners’ very effective parallel command structure. The book shows how Anglo-Irish and intra-Irish relations were profoundly affected and how the prisoners’ involvement and consent were critical to the Good Friday Agreement that ended the long war. The final part of a trilogy dealing with Irish political prisoners from 1848 to 2000 by renowned expert Seán McConville, this is an essential resource for students and scholars of Irish history and Irish political prisoners; it is also a major contribution to the study of imprisonment.

Book Colonial and Post colonial Constitutionalism in the Commonwealth

Download or read book Colonial and Post colonial Constitutionalism in the Commonwealth written by Hakeem O. Yusuf and published by Routledge. This book was released on 2013-12-17 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: The peace, order and good government (POGG) clause is found in the constitutions of almost all Commonwealth countries. Since its introduction, the clause has played a significant role in colonial and post-colonial constitutionalism in Commonwealth jurisdictions. This book is the first full length analysis of the various dimensions of the peace, order and good government clause. It argues that the origins of the POGG clause mark it out as an anachronistic feature of British constitutionalism when seen against a modern setting of human rights, liberty and democratisation. The book traces the history, politics and applications of the clause through the colonial period in Commonwealth territories to date. It provides critical evaluation of the POGG clause in a cross-continental enquiry, examining statutory, political and constitutional deployment in Australia, Canada, India, Nigeria, South Africa and the United Kingdom. The evaluation demonstrates that the POGG clause has relevance in a number of significant aspects of legal and socio-political ordering across the Commonwealth featuring prominently in the federalism question, emergency powers and the review of administrative powers. It maintains that while the clause is not entirely devoid of positive value, the POGG clause has been used not only to further the objects of colonialism, but also authoritarianism and apartheid. This book calls for a rethink of the prevailing subjective approach to the interpretation of the clause. The book will be of interest to students and academics of public law, human rights law, and comparative politics.

Book Transitional Justice and Legacies of State Violence

Download or read book Transitional Justice and Legacies of State Violence written by Lisa White and published by Routledge. This book was released on 2015-03-05 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: As politicians, public bodies and non-Governmental organisations continue to profess an interest in making peace with the past, this highly original study explores the motivation, significance and legacy of ‘making public’ experiences of state violence in Northern Ireland. Based on a synthesis of documentary material with the findings from a series of contemporary interviews, this timely book uncovers the reasoning behind many Republican former detainees’ accounts of state violence and torture. It examines the aims of those who ‘went public’ during the conflict and discusses the meaning they attached to their stories and the various responses to them. It also identifies some of the risks involved in criticising the violence of the British State and illuminates the ways in which ‘truths’ are often contested in Northern Ireland - both during the conflict and in the years which have followed. A unique piece of interdisciplinary work, the study disentangles and evaluates the discourses presented by former detainees and makes an innovative and interesting contribution to knowledge about transitional justice and legacies of state violence. The book is suitable for social science scholars interested in human rights, state violence, criminology and transitional justice, as well as those seeking to understand more about experiences of imprisonment and the legacy of the Northern Ireland conflict.
