Book excerpt: Following the Supreme Court's decision in Citizens United v. Federal Election Commission there is still one type of corporation that cannot engage in political speech: the nonprofit corporation. Section 501(c)(3) of the Internal Revenue Code prevents nonprofit corporations that hold tax-exempt status from participating in “any political campaign on behalf of (or in opposition to) any candidate for political office.” But recent events show a growing call to reform this provision, referred to as the political activities prohibition. These events include new First Amendment developments, charities allegedly flouting the prohibition in recent elections, the 2013 IRS targeting scandal, and finally a notice of proposed rulemaking promulgated by the IRS and the Treasury Department in 2013 that could change the political activity regulations for both section 501(c)(3) and section 501(c)(4) organizations.This Note responds to these recent events and discusses the purpose and structure of the political activities prohibition, both within section 501(c)(3) and in connection with section 501(c)(4). The Note then examines different constitutional challenges to the political activities prohibition, including First Amendment and selective prosecution challenges stemming from the IRS' alleged haphazard enforcement of the prohibition. This Note concludes that the political activities prohibition should not be eliminated, but advocates implementing several laws and agency policies to ensure even enforcement of the prohibition.

Book excerpt: Governments fail to provide the public goods needed for development when its leaders knowingly and deliberately ignore sound technical advice or are unable to follow it, despite the best of intentions, because of political constraints. This report focuses on two forces—citizen engagement and transparency—that hold the key to solving government failures by shaping how political markets function. Citizens are not only queueing at voting booths, but are also taking to the streets and using diverse media to pressure, sanction and select the leaders who wield power within government, including by entering as contenders for leadership. This political engagement can function in highly nuanced ways within the same formal institutional context and across the political spectrum, from autocracies to democracies. Unhealthy political engagement, when leaders are selected and sanctioned on the basis of their provision of private benefits rather than public goods, gives rise to government failures. The solutions to these failures lie in fostering healthy political engagement within any institutional context, and not in circumventing or suppressing it. Transparency, which is citizen access to publicly available information about the actions of those in government, and the consequences of these actions, can play a crucial role by nourishing political engagement.

FEC, tax-exempt social welfare groups (also known as 501(c)(4) organizations) increasingly are used in political campaigns, often instead of political organizations (also known as PACs, SuperPACs, or 527s). This Article first compares the tax law treatment of social welfare organizations to that of political organizations. Although section 501(c)(4) organizations have several key advantages, including anonymity for donors and tax preferred financing, unlike 527s, 501(c)(4)s face a limit on their political activities (the “primarily” test). IRS efforts to police the primarily test caused a political firestorm, sometimes referred to as the “Tea Party” targeting controversy. The Article explains that the root cause of the controversy is inconsistent federal disclosure law, which was largely a byproduct of Citizens United. The Article argues that so long as 501(c)(4) offers preferred treatment for campaign activity, political operatives will have strong incentives to organize as 501(c)(4) organizations and exploit ambiguities in the law and weak IRS enforcement. The result is and will continue to be a gradual erosion of the rule of law, destabilization of the tax exemption system, and damage to the reputation of the IRS as an essential government agency. The Article discusses possible solutions to the controversy. Most importantly, Congress should end the ability to engage in statutory arbitrage and provide for consistent treatment of campaign activity between 501(c)(4) and political organizations. Consistent rules would also pave the way to reconsider the current limits on political activity that apply to 501(c)(4) organizations. Overall, consistent rules and fewer limits would simplify tax administration, improve compliance, and embrace free speech.

She considers the ways in which fan-based social engagement arises organically, from fan communities seeking to change their world as a group, as well as the methods creators use to leverage their fans to take social action. The modern shift to networked, fluid communities, Hinck argues, opens up opportunities for public participation that occurs outside of political parties, houses of worship, and organizations for social action. Fan-based citizenship performances help us understand the future possibilities of public engagement, as fans and creators alike tie the ethical frameworks of fan-objects to desired social goal, such as volunteering for political candidates, mentoring at-risk youth, and promoting environmentally friendly policy.
