Book excerpt: This book explains the details and underlying thinking of many major reforms to Chinese law and legal practice that have taken place since 2013. It draws widely on laws and regulations, policies, cases, official statistics as well as the latest Chinese and foreign literature. The informed analysis answers intriguing questions such as why China runs the world’s largest database of court judgments without recognising any precedent, or why the number of judges was cut by 40% despite a more than doubled caseload. Ultimately it offers a new approach on how to understand Chinese law and legal reforms in the contemporary world.

Book Criminal Justice in Post Mao China

Download or read book Criminal Justice in Post Mao China written by Shao-chuan Leng and published by SUNY Press. This book was released on 1985-06-30 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: The post-Mao commitment to modernization, coupled with a general revulsion against the lawlessness of the Cultural Revolution, has led to a significant law reform movement in the People’s Republic of China. China’s current leadership seeks to restore order and morale, to attract domestic support and external assistance for its modernization program, and to provide a secure, orderly environment for economic development. It has taken a number of steps to strengthen its laws and judicial system, among which are the PRC’s first substantive and procedural criminal codes. This is the first book-length study of the most important area of Chinese law—the development, organization, and functioning of the criminal justice system in China today. It examines both the formal aspects of the criminal justice system—such as the court, the procuracy, lawyers, and criminal procedure—and the extrajudicial organs and sanctions that play important roles in the Chinese system. Based on published Chinese materials and personal interviews, the book is essential reading for persons interested in human rights and laws in China, as well as for those concerned with China’s political system and economic development. The inclusion of selected documents and an extensive bibliography further enhance the value of the book.

Download or read book Law and Legality in China written by Laszlo Ladany and published by University of Hawaii Press. This book was released on 1992-01-01 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fr Laszlo Ladany, SJ, published only one book in his lifetime (The Communist Party of China and Marxism, 1921-1985: A Self-Portrait), but became widely known and respected as the doyen of 'China-watchers' through his editorship of China News Analysis in Hong Kong in 1953-82. On his death in 1990 he left this survey, simply expressed but revealing on every page the depth of his knowledge of the Chinese people and of Chinese and comparative legal history, one of his own earlier special subjects of study. His ultimate concern is to illustrate the antipathy of Mao Tse-tung to law, even in a form renewed according to Marxist doctrine, and to age-old customary Chinese concepts of acceptable behaviour: this created a mental and spiritual void in a whole generation of Chinese with possibly irreversible and certainly unpredictable consequences. The book is a deeply thought-provoking introduction to the study of Chinese history, politics and culture. Two distinguished German sinologists, Professor Jurgen Domes and Dr Marie-Luise Nath, have, between them, edited the work and provided short opening and concluding sections.

Book Tradition of the Law and Law of the Tradition

Download or read book Tradition of the Law and Law of the Tradition written by Xin Ren and published by Bloomsbury Publishing USA. This book was released on 1997-03-25 with total page 198 pages. Available in PDF, EPUB and Kindle. Book excerpt: Traditionally, social theorists in the West have structured models of state social control according to the tenet that socialization is accomplished by means of external controls on behavior: undesirable actions are punished and desirable actions result either in material reward or a simple respite from the oppressive attentions of an authoritarian state. In this volume, the author presents the tradition of law in China as an exception to the Western model of social control. The Confucian bureaucracy that has long structured Chinese social life melded almost seamlessly with the Maoist revolutionary agenda to produce a culture in which collectivism and an internalized adherence to social law are, in some respects, congenital features of Chinese social consciousness. Through her investigation of the Maoist concept of revolutionary justice and the tradition of conformist acculturation in China, the author constructs a fascinating counterpoint to traditional Western arguments about social control.
