Its GDP has grown from 150 billion to 1.65 trillion USD and its per capita GDP from 190 to more than 1,200 USD. However, the resources that such growth demands have raised concerns about the long-term sustainability and hidden costs of the growth. Many of these concerns are associated with the state of Chinas water resources. As demand for water has increased, so too have problems with water shortages, pollution, falling groundwater tables and flood/drought damages. To tackle these challenges the Chinese government increasingly encourages foreign companies to engage in the Chinese water market. Market research studies claim that this market holds promising business opportunities for both domestic and foreign companies. This thesis questions this observation from a foreign investor's perspective. It shows that the Chinese water market indeed holds business opportunities, but that these opportunities are mainly tied to certain sectors and regions. A questionnaire carried out between foreign managers showed that these opportunities go together with high market entry barriers and high market risks. Therefore, this thesis pays special attention to potential risk treatment measures which take the position of foreign companies and the special characteristics of the Chinese water market into account. The paper contains six chapters. After an analysis of the business environment of the Chinese water service market, the thesis describes business opportunities for foreign companies. Afterwards potential risks for foreign investors are discussed and measures for a strategic risk treatment introduced.

Book excerpt: "China has experienced a wide-scale and rapid transformation from an agricultural based economy to the manufacturing workshop of the world. The associated relocation of the population from relatively low density rural areas to very high density urban areas is having a significant impact on the quantity and quality of water available as inputs into the production and consumption process, as well as the ability of the water system to absorb and neutralize the waste byproducts deposited into it. Water shortages are most severe in the north of the country, where surface water diversion is excessive and groundwater is being depleted. In addition, the quality of water is deteriorating because of pollution, thereby aggravating existing water shortages. The biggest challenge ahead will be for national and local governments to craft policies and rules within China's complex cultural and legal administrative system that provide incentives for users to increase efficiency of water use, and for polluters to clean up the water they use and return clean water to stream flows. Using a standard public economics framework, water requirements for public goods-such as ecosystem needs-should be set aside first, before allocating property rights in water (to enable water markets to function and generate efficient allocation signals). Even then, water markets will have to be regulated to ensure public goods, such as public health, are not compromised. Until water markets are implemented, staying the course on increasing water and wastewater prices administratively and encouraging water conservation are necessary to reduce the wasting of current scarce water resources, as well as the new water supplies to be provided in the future. In recent years the cases of water shortages, pollution and flood/drought damages steadily increased in numbers. This development is caused by both a large population and a rapidly developing economy. Although China significantly improved its water and wastewater infrastructure, its water shortage problem is worsening year by year. The Chinese government tries to counter this misbalance and insistently pursues an environmentally sustainable development policy. Its countermeasures include management model reforms, Private-Sector-Participation (PSP) projects and the support of new technology development and application. According to the 11th Five-Year-Plan, more than 140 billion Euros will be spent on environmental projects and campaigns before 2010. These reforms have unleashed a wave of optimism in China‟s water market and created great market opportunities for investors. Significant amounts of new water infrastructures are to be built, and the operation and maintenance of all existing and newly built municipal water and wastewater treatment plants have been or will be transferred to authorized enterprises. However, these opportunities are not without risk. Investors are particularly skeptical about the development of the legal environment. The contradiction of theory and practice is striking. On one hand China‟s legal framework for environmental protection appears extensive and strict. On the other hand a violation of these regulations is seldom sanctioned. This paper tries to analyze this ambivalent picture. It examines the key regulations of the Chinese water sector, illustrates the interdependencies between the relevant authorities and analyzes their implications on investment opportunities for foreign enterprises.

What accounts for this dramatic change in this critical policy area surrounding China's insatiable quest for energy? In China's Water Warriors, Andrew C. Mertha argues that as China has become increasingly market driven, decentralized, and politically heterogeneous, the control and management of water has transformed from an unquestioned economic imperative to a lightning rod of bureaucratic infighting, societal opposition, and open protest. Although bargaining has always been present in Chinese politics, more recently the media, nongovernmental organizations, and other activists—actors hitherto denied a seat at the table—have emerged as serious players in the policy-making process. Drawing from extensive field research in some of the most remote parts of Southwest China, China's Water Warriors contains rich narratives of the widespread opposition to dams in Pubugou and Dujiangyan in Sichuan province and the Nu River Project in Yunnan province. Mertha concludes that the impact and occasional success of such grassroots movements and policy activism signal a marked change in China's domestic politics. He questions democratization as the only, or even the most illuminating, indicator of political liberalization in China, instead offering an informed and hopeful picture of a growing pluralization of the Chinese policy process as exemplified by hydropower politics. Although recent water reform in China has made substantial progress in policy development and practice, how its legal and institutional framework facilitates or hinders the application of tradable water rights remains less addressed in the existing scholarship. Against the backdrop of China’s water reform and the wider international debate in water governance, this book aims to provide an innovative approach to the complex issue of water governance by critically analysing the recent legal and policy developments in China towards tradable water rights. It examines the deficiencies of the current systems for water rights arrangements and trading, explores how China may learn from and build on the international trends in water rights trading practice (mainly Australia and the US), and proposes legal and policy frameworks for defining and administering tradable water rights in China that underpin sustainable water use in the face of exacerbated water scarcity, variability, and uncertainty. All in all, the book proposes pragmatic strategies for China’s water law and policy reform to move towards tradable water rights, which encompasses a comprehensive prescription from initialising and defining tradable water rights to administering water rights and trading. By reflecting on the deepening water reforms in both China and other jurisdictions, the book aims to contribute to the international water governance debate by exploring from a legal and policy perspective, how China, comparative to other cases around the world, can find a balanced combination of water allocation mechanisms to address its water challenges.
