Book Full Restitution for Child Pornography Victims

Download or read book Full Restitution for Child Pornography Victims written by Paul G. Cassell and published by . This book was released on 2017 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this article, we have reviewed the legal issues surrounding restitution for child pornography victims. In our view, the Supreme Court's Paroline decision failed to fully implement the congressional mandate that victims receive restitution for the “full amount” of their losses. Congress should move swiftly to ensure full restitution for child pornography victims by enacting the proposed Amy and Vicky Act -- a more rational scheme for awarding restitution.

  • Author : Richard G. Wright
  • Publisher : Lexington Books
  • Release : 2019-10-15
  • ISBN : 1793600589

Download or read book American Violence written by Richard G. Wright and published by Lexington Books. This book was released on 2019-10-15 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: Richard Wright analyzes the current state of violence in America, the criminal justice system’s response, and the experiences of survivors in the aftermath of a violent crime. Despite decades of advocacy, change, and research, our policy responses embedded with historic and systemic values which rank victims and survivors not based on their trauma and loss, but by race, social status, gender, location, and age, remain quite flawed. Keeping the big picture in mind, Wright analyzes the unintended consequences of current, well-meaning policies, critiques the victim hierarchy, and sheds light on why American responses to the needs of violent crime victims have accrued a more failures than successes.

Book Refining Child Pornography Law

Download or read book Refining Child Pornography Law written by Carissa Byrne Hessick and published by University of Michigan Press. This book was released on 2016-05-10 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: The legal definition of child pornography is, at best, unclear. In part because of this ambiguity and in part because of the nature of the crime itself, the prosecution and sentencing of perpetrators, the protection of and restitution for victims, and the means for preventing repeat offenses are deeply controversial. In Refining Child Pornography Law, experts in law, sociology, and social work examine child pornography law and its consequences in an effort to clarify the questions and begin to formulate answers. Focusing on the roles of language and crime definition, the contributors discuss the increasing visibility child pornography plays in the national conversation about child safety, and present a range of views regarding the punishment of those who produce, distribute, and possess materials that may be considered child pornography.

Book Offenders and the Sexual Abuse of Children

Download or read book Offenders and the Sexual Abuse of Children written by James A. Cates and published by Taylor & Francis. This book was released on 2024-11-22 with total page 159 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book synthesizes the nascent but growing body of literature and research emerging on risk management and treatment of persons who sexually offend against children. This volume demonstrates the need for change by placing current attitudes toward sexual offending in their sociocultural context and then discussing the impact of these attitudes. Rather than parse the needs of children who have been victimized from those who have offended, a model emerges that explains the interlocking dynamics of those who offend and those offended against. This book upends the convenient fiction that child sexual abuse can be reduced by locking away those who offend and then monitoring them upon release. Rather, the book addresses the need for ongoing interaction of the two populations; the reality that the two populations at times overlap; and the increasingly public question of how to manage those who acknowledge an attraction to children but deny an intent to act on that desire. Providing alternative viewpoints, research avenues, and policy options that can accommodate a more realistic effort to reduce the risk of sexual abuse, it is a must read for all policymakers or professionals working with those who have offended or acknowledge attraction to children, alongside students and researchers from forensic psychology, clinical psychology, or criminology backgrounds.

Book Digital Child Pornography

    Book Details:
  • Author : Chad M.S. Steel
  • Publisher : Lily Shiba Press
  • Release : 2014-01-30
  • ISBN : 0615947980
  • Pages : 214 pages

Download or read book Digital Child Pornography written by Chad M.S. Steel and published by Lily Shiba Press. This book was released on 2014-01-30 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: Child pornography is a critical legal and ethical problem that has experienced a resurgence coincident with the growth of the Internet. After international efforts to amend child protection laws in the late 1970’s and early 1980’s, the prevalence of child pornography cases dropped precipitously and the distribution of child pornography was largely limited to the back rooms of adult bookstores, small cells of individual traders, and a limited, known list of overseas mail order providers. With the growth of the Internet, the ease, cost, and relative anonymity of transactions greatly increased the availability of child pornography and the number of child pornography offenders. Digital Child Pornography: A Practical Guide for Investigators seeks to address the problems faced in investigating child pornography offenses in the always-on, always-connected age. The contents of this book are organized into three sections as follows: • Foundations. The background and modern history of child pornography are covered. The prevalence and types of child pornography are addressed, and a typology of child pornographers is presented, including the psychological reasons for the individuals to be engaged in child pornography. An overview of the current federal laws addressing child pornography is presented, and key cases of recent interest are detailed. How to select investigators to investigate child pornography offenses and how to keep them safe are also reviewed. • Digital Forensics. Digital forensics, as applied to child pornography, is addressed. A methodology for planning for and conducting search warrants in child pornography offenses is provided, and key elements of proof needed that can be gathered digitally are presented. A framework for conducting dead-box analysis for evidence of child pornography offenses is provided. • Interviews and Interrogations. The subjects of child pornography cases take special care and feeding and they require special considerations when interviewing. The process of interviewing and interrogating child pornography subjects, from the planning stages through to obtaining a confession, is documented. Digital Child Pornography: A Practical Guide for Investigators is written by an investigator specifically for other child pornography investigators and provides the most comprehensive guide to these investigations currently available.

Book Sentencing Advocacy

  • Author : C.J. Williams

Download or read book Sentencing Advocacy written by C.J. Williams and published by McFarland. This book was released on 2023-01-03 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: To ensure a fair criminal trial, effective sentencing advocacy is needed in every stage of prosecution, from investigation through plea, trial and sentencing hearings. With fewer criminal cases proceeding to trial, advocacy is increasingly critical for both prosecutors and defense attorneys and can determine whether or not a defendant receives an appropriate sentence. Here is a volume that comprehensively describes the steps to effective sentencing advocacy, addressing not only terms of imprisonment or probation, but fines, forfeiture, restitution and other collateral sentencing consequences. It emphasizes approaching sentencing advocacy holistically, treating it as a key component of attorney advocacy in every criminal case. Covering the fundamental sentencing procedures and concepts, it describes where and how attorneys can use advocacy to advance their clients' goals. It also explains aspects of sentencing that otherwise may appear too complex to a novice criminal practitioner. Importantly, this is not a book on sentencing law, although it addresses legal sentencing issues as they pertain to sentencing advocacy. Rather, the focus is on teaching attorneys how to use advocacy to achieve the best sentence for their clients.
