Adoptée le 28 juin 1981 à Nairobi, elle est entrée en rigueur le 21 octobre 1986. Cet instrument consacre des droits individuels et collectifs. Bien qu'il reprenne certains droits consacrés par la Déclaration Universelle de 1948, il présente une certaine spécificité. Celle-ci réside dans une approche qui allie de manière indissociable droits de l'homme et droits des peuples, droits de l'homme et devoirs. Elle accorde une importance particulière au droit au développement et en fait une condition de respect des droits civils et politiques. On retrouve l'approche collectiviste qui a permis aux Etats africains d'anéantir les droits de l'homme. Afin d'assurer la protection de ces droits, la Charte met en place un mécanisme politique. Ce dernier est composé d'un organe d'étude et de conciliation qui est la Commission et d'un organe politique, la Conférence des chefs d'Etat et de gouvernement de l'O.U.A. C'est sur la Conférence que repose l'essentiel du mécanisme de protection car il détient l'énorme pouvoir de sanction qui est de publier les rapports sur les violations des droits. La mise en œuvre de ce mécanisme a révélé ses faiblesses et ses lacunes, et partant son inefficacité. En réalité, la Charte ne constitue pas une réelle évolution dans la résolution du problème des violations des droits de l'homme en Afrique. Elle se situe dans une perspective de continuité de la politique de sauvegarde des souveraineté étatiques. Cependant, cette protection pourrait être améliorée. Ceci passerait par une dynamisation du système de protection et un devoir d'ingérence.
