Book excerpt: Excerpt from Certaine Considerations Upon the Government of England Primogenitura facit appanagium: but courtiers then swallowed up employments which have in later times been a happy resource for the scions of influential county families; and the squire of the seventeenth century had to provide means for cadets, which a more skilful age has sought in other modes of provision than a careful and frugal economy. And yet, amidst all the distractions of political and public life, and the cares imposed upon him by his station and domestic circumstances, undeterred by difficulty, undismayed by persecution, we find him devoting the energies of a powerful mind to the investigation of our national antiquities, rendering some of our earlier authorities accessible for the first time to his fellow countrymen, and finally producing two of the most remarkable contributions we yet possess to our ecclesiastical and political history. The student in an age like this, when the means of collecting knowledge are widely diffused, and the aids to its co-ordination and implication sufficiently supplied, can form but a faint notion of the difficulties which, in the seventeenth century, still beset the path of the historical inquirer. Much that is now accessible through a never resting press was then still locked up in manuscripts, too often guarded with jealous care from the eye of a stranger. No British Museum opened its hospitable doors to every respectable applicant; and even though Cotton and D'Ewes, and other equally noble men, gave great facilities to all who had any claims upon their notice, in many cases long negotiations and no little diplomacy were necessary in order to obtain sight of a rare book or valuable manuscript. An attempt, therefore, to study it at any salient epoch cannot be value less; and the present is a salient epoch, for the nation has now enjoyed something very near to manhood suffrage in the boroughs for forty years, and throughout the country more than twenty years, a period long enough for democ racy to produce its primary if not its ultimate effects. Moreover, England has one of the most interesting of popular governments, because it has had a free develop ment, little hampered by rigid constitutional devices. It is an organism constantly adapting itself to its environ ment, and hence in full harmony with national conditions. An endeavour has been made in these volumes to portray the present form of that organism and the forces which maintain its equilibrium. In preparing a study of this kind one feels the need of limiting its scope, by reducing the denominator as Arthur Helps remarked. Hence the work covers only the English government as it stands today; and further, only those institutions, national and local, that have a general bear ing. The British Constitution is full of exceptions, of local customs and special acts with which town clerks must be familiar. They fill the path of these men with pitfalls, but they do not affect seriously the general princi ples of the government, and no attempt is made to describe them here. It is a fact I have bad to keep in mind in preparing for the press this new edition of a book first published more than nine years ago. Such fidelity to the original as the sketch may hare possessed when executed might be lost in the attempt to make it a register of all the changes which time has wrought upon the features of the subject. The task would be one of peculiar difficulty at the present moment; for my revised edition is called for, as it happens, while the structure of our polity is undergoing a process of reconstruction still incomplete. With the ultimate form and powers of the Upper Chamber in suspense, and with the revolution in the government of Ireland impending but undecided, it would be futile to pass a definite judgment on transitory developments which must eventually assume a more definite and tangible shape. And so, while drawing some fresh illustrations and arguments from the events of the past few years, I prefer to leave this book as, in the main, an account of the "working constitution" of the United Kingdom in the opening decade of the twentieth century.
