Book excerpt: Excerpt from Cases Illustrating the Principles of the Law of Torts Owing to the exigencies of space it has been necessary to omit portions of the cases as originally reported. This has been done for the most part by omitting or reducing long statements of Tacts, arguments of counsel where not necessary to explain the judgements, and concurring judgements where they did not seem to add anything to that reported. Where a judgement has dealt with more than one subject those portions which are not relevant to the principle under discussion have been omitted. Excisions from a judgement have been indicated by dots. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Cases Illustrating the Principles of the Law of Torts This book is an attempt to illustrate the principles underlying the main branches of the Law of Torts by a selection from the original authorities. With this object in view the headnotes of all the cases have been rewritten so as to state the principle established by each case rather than, the application of that principle to a particular set of facts. The notes are mainly explanatory or supplemental; but in two or three cases, as in the note to Asher v. WTiitloch; they are an attempt to present an accurate statement of the existing law on certain difficult points. Owing to the exigencies of space it has been necessary to omit portions of the cases as originally reported. This has been done for the most part by omitting or reducing long statements of facts, arguments of counsel where not necessary to explain the judgements, and concurring judgements where they did not seem to add anything to that reported. Where a judgement has dealt with more than one subject those portions which are not relevant to the principle under discussion have been omitted. Excisions from a judgement have been indicated by dots. Book Leading Cases Upon the Law of Torts Classic Reprint

Download or read book Leading Cases Upon the Law of Torts Classic Reprint written by George Chase and published by Forgotten Books. This book was released on 2017-09-12 with total page 420 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Leading Cases Upon the Law of Torts This collection of cases upon the Law of Torts is intended. To supple ment and illustrate the statements of legal principles which are set forth in the various treatises upon this subject. Object lessons, show ing the application of principles, are as efficacious in the study of law as in the study of other branches of learning, and such lessons are afforded by the actual decisions made by the courts in specific instances. Such decisions may also exhibit the growth and development of legal doctrines. The aim has been to select the most valuable and important cases that could be found, giving a comprehensive view of the particular point or question discussed, and presenting the actual living law of to-day as the result of the long process of adjudication in England and in this country. Hence the volume comprises modern cases to a large extent, and in some instances these are among the most recent that have been issued. The cases are printed in the same general form in which they ap pear ih the regular reports, viz., with head - notes, statements of facts, and sometimes arguments of counsel, prefixed to the Opinions. Run ning head-lines in bold-faced type, also, direct the attention of the reader to the principle treated of in the particular case that follows. Numerous other valuable cases are also cited after each of those that are printed in full, so that the reader can extend his researches more widely, if he so desires. These cited cases are also among the most important authorities upon the various points discussed. G. C. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. This book was released on 2017-11-04 with total page 550 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases Illustrating General Principles of the Law of Contract We might easily have included more cases had we not thought it desirable to print at least one judgement Without any omissions from every case but we believe that much of the benefit that a student may derive from reading the reports at first hand depends on his learning to extract for himself, as he will later have to do in practice, the ratio decidendi, instead of having this done for him by omissions of the less material parts of a judgement, or even by headnotes. This conviction also explains the plan which we have adopted in the note prefixed to each case, which is intended, not as an analysis, but rather as an indication of the general subject-matter of the case which it precedes. Book The Foundations of Legal Liability Vol 1

Download or read book The Foundations of Legal Liability Vol 1 written by Thomas Atkins Street and published by Forgotten Books. This book was released on 2016-09-14 with total page 536 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Foundations of Legal Liability, Vol. 1: A Presentation of the Theory and Development of the Common Law; Theory and Principles of Tort The present volume contains a new synthesis of the fundamental principles of tort along scientific and historical lines. The aim has been to discover and indicate the true path of legal evolution in this complicated field. As might be expected from the adoption of new methods of inquiry, and from the opening of new lines of thought, we have turned up many new ideas and have been able to present the old truths in new and more enlightening aspects. The discovery and establishment of what we have called the 'secondary trespass formation' represent, we make bold to believe, a considerable advance in legal knowledge. It gives insight into the nature of a class of torts which have hitherto proved somewhat intractable, and enables us to assign the conception of negligence to its proper place in legal theory. The reader will find that this subject of negligence has been much stirred. We have pointed out its complexity and have shown the reason for the difficulties which are here encountered. Above all, we have illustrated this branch of the law with a copiousness of concrete cases not attempted in connection with any other subject. For the convenience of those who may desire to discriminate we have had the illustrative matter printed in a smaller type than that which is used for the ordinary text. Book Principles of the Law of Damages Classic Reprint

Download or read book Principles of the Law of Damages Classic Reprint written by Hugh Evander Willis and published by Forgotten Books. This book was released on 2017-10-16 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of the Law of Damages The general purpose of this new book on the law of Damages is like the purpose of the book on the law of Contracts by the same author, to give a complete treatise on the subject in a small volume. All the fundamental principles of the law of Damages are summarized in rules, or propositions of'law. Explanations are given for these propositions of law, with reasons therefor, together with criticisms thereof, whenever in the judgment of the author the rules are the subject of criticism. In order to further elucidate the propositions, copious illustrations are given, showing the application of the same. Under such a plan it is hoped that anyone reading the book will obtain a thorough understanding of the law of Damages. For the convenience of the reader the propositions of law, explanations and illustrations, are printed in different type. The illustrations used are founded upon the cases selected by Professor Beale and by Professor Mechem for their case books on Damages and upon such other cases as the author has deemed it expedient to incorporate in the vdume.
