Excerpt: ...a very strong state of facts must appear from the testimony to raise a contrary presumption. The defendant, therefore, stands in the position of tenant at will to Smith, and such an occupancy could not give title as against the plaintili's. It is true there is no evidence that defendant paid rent to plaintiffs or their father, but the witnesses speak of his having more privileges than others who used the land during the fishing season, and these privileges I infer to have been those of a sonin-law occupying permissively. Besides this, there are material portions of the evidence in favor of the defendant which were proved by witnesses who undertook to speak positively of facts which occurred before they were nine years of age. The jury may have rejected the testimony of these persons in a case like this where there was conflicting testimony, and I cannot but think that the jury might reasonably have drawn such conclusions from the evidence as would sustain this verdict, independently of my views of the law. Donn, J. In this action the lessors of the plaintiff seek to recover upon a prior possession; neither plaintifi' nor defendant show a documentary title. The defendant proves possession of part of the disputed premises from 1841. There is also some evidence to show previous acts of ownership on his part, and in 1843 he built a store upon the ground to the northward of a brook which the plaintiff claims as his southern boundary. The disputed ground is called the " Green," and is between two brooks, and fronts on Crow Harbor. The lessors claim as devisees under the will of their father, George Smith, who died in the year 1850, and they prove his possession as far back as 1826, and con tinuing from that time to 1841, ...

Excerpt: ...notes to be a legal tender in payment of all debts, public and private, within the United States, except duties on imports and interest, &c.; but it cannot be said that the debt claimed by the plaintiffs is a debt due and payable either as a public or private debt within the, United States, and to no other class of debts than those referred to in the Act can it be applicable. A debt due and payable in Nova Scotia, in law, -can only be liquidated by the moneys mentioned in the Currency Act of the Province. Dollars and cents of the United States currency, if not referable solely to the dollar and cent current in that country when the contract was made, must refer to a dollar and cent current for all purposes; but, as I have said, the paper issue under the Act of Congress is not for all purposes, but limited in its operation, and if the plaintiffs were now held to the tender made by the defendants, and had moneys to pay in the United States for either of the excepted purposes of the Act, the moneys received 1864. from the defendants would not be available for that NON BCOTIA purpose; that consequence, then, cannot, in my C0-f;HY opinion, be a just and reasonable solution of the.1'.; i, f:, 1'H contract. C""""-If I had any doubt respecting this case, as to the justice of my views with reference to the defendants being liable to the plaintiffs in the current money of the United States when the contract was entered into, or what is. equivalent to that currency, the case of Pilkington v. Commissioners for Claims, 2 Knapp R. 17 to 21, would remove the doubt.
