Not only were many former European colonies turned into sovereign states, there was also an ongoing process of region-making recognizable throughout the hemisphere and obvious through the establishment of several regional agreements. The emergence of political and economic regional integration blocs is a very timely topic analyzed by scholars in many disciplines worldwide. This book looks at remapping the recent trends in region-making throughout the Americas in a way that hasn’t been at the center of academic analyses so far. While examining these regionalisation tendencies with a historical background in mind, the authors also answer fundamental questions such as: What influences does globalization have on region-making, both on normative regionalism plans as well as on actual economic, political, cultural, military and social regionalization processes driven by state and non-state actors? What ideas or interests lead states in the Americas to cooperate or compete with one another and how is this power distributed? How do these regional agreements affect trade relations and have there been trade barriers set up to protect national economies? What agreements exist or have existed and how did they change with regard to contents and for what reason? The book informs academic as well as non-academic audiences about regional developments in the Americas, in particular those dating back to the last twenty years. Both organisations are operating under new treaties, the Revised Treaty of Chaguaramas and the Revised Treaty of Basseterre, respectively, which created the CARICOM Single Market and Economy, and the OECS Economic Union. The single market and economic union were built upon principles of free movement of goods, labour, and capital, and a common external tariff. This book reviews the foundations of Caribbean regional integration, the institutional frameworks of the two regional organisations, and fleshes out the scope and context of the legal systems created by the treaties. It also reviews the dispute settlement mechanisms under both treaties, including the increasingly active role of the Caribbean Court of Justice, which allows persons to enforce their treaty rights directly before the Court. The book offers selective comparisons to the current rules governing the European Union, and integrates crucial insights from the field of public international law, including the law of treaties and international institutional law.

For most of the advanced countries, trade has raised standards of living, while for most emerging economies, growth did not begin until their integration into the global economy. The economic explanation is simple: international trade facilitates specialization, increased efficiency and improved productivity to an extent impossible in closed economies. However, recent years have seen a significant slowdown in global trade, and the global system has increasingly come under attack from politicians on the right and on the left. The benefits of open markets, the continuation of international co-operation, and the usefulness of multilateral institutions such as the World Trade Organization (WTO), the International Monetary Fund and the World Bank have all been called into question. While globalization has had a broadly positive effect on overall global welfare, it has also been perceived by the public as damaging communities and social classes in the industrialized world, spawning, for example, Brexit and the US exit from the Trans-Pacific Partnership. The purpose of this volume is to examine international and regional preferential trade agreements (PTAs), which offer like-minded countries a possible means to continue receiving the benefits of economic liberalization and expanded trade. What are the strengths and weaknesses of such agreements, and how can they sustain growth and prosperity for their members in an ever-challenging global economic environment? International organizations are nowadays ubiquitous and come in many different manifestations, each allowing for different levels of international cooperation. The profile of regional and universal organizations may vary greatly from one organization to another. At the same time, they do not live apart and this has led to the creation of a complex network of relationships. These relationships have seldom been the object of scholarship, and this book seeks to address that gap. In general, the relationships between international organizations can give rise to such issues as the conditions placed upon one organization by another, demarcations of competence, membership of other organizations, and various forms of collaboration involving the conclusion of agreements between organizations. Optimal coexistence, cooperation and coherence all play a role in optimizing the relations between international organizations. The volume concludes by analysing current challenges, including those of legal identity, responsibility and accountability, as well as making proposals for reform, such as through the development of a common law between organizations.

Book excerpt: In the Western Central Atlantic Fishery Commission (WECAFC) area, large pelagics contribute only about 6% of total landings, but are nonetheless significant for many countries. Large pelagic fishes are caught in all WECAFC states, and within the WECAFC region by several distant water fishing nations. However only 19 of 40 WECAFC Member States report catches to FAO. The fisheries range in scale and technological sophistication from artisanal fishers trolling from canoes to modern commercial longliners and purse seiners (mostly from distant water fishing nations). The available information on development of small-scale and large scale fleets targeting large pelagics, indicates a significant trend of increasing fishing capacity in the countries of the WECAFC region. Several species which are not assessed by ICCAT are of considerable importance in large pelagic fisheries in the WECAFC region. Overall, about half the landings of large pelagics in the WECAFC region are from species which are assessed. Existing institutional mechanisms are not adequate for management of shared or straddling fish stocks and those of highly migratory fish, as per the recent UN Agreement. Any such institution must have linkages with extraregional organisations, primarily ICCAT, and, in order to maximise efficiency and avoid duplication, should also be able to deal with shared, straddling and migratory fish stocks other than pelagics, for example, lobster and reef fishes with planktonic early life history stages. WECAFC, with modifications to its statutes, appears to be the most feasible existing organisation to adopt such a role.
