Both organisations are operating under new treaties, the Revised Treaty of Chaguaramas and the Revised Treaty of Basseterre, respectively, which created the CARICOM Single Market and Economy, and the OECS Economic Union. The single market and economic union were built upon principles of free movement of goods, labour, and capital, and a common external tariff. This book reviews the foundations of Caribbean regional integration, the institutional frameworks of the two regional organisations, and fleshes out the scope and context of the legal systems created by the treaties. It also reviews the dispute settlement mechanisms under both treaties, including the increasingly active role of the Caribbean Court of Justice, which allows persons to enforce their treaty rights directly before the Court. How is it that a great swath of the independent, English-speaking Caribbean continues to accept the judicial oversight of their former colonizer via the British institution of the Privy Council? And what possibilities might the CCJ--a judicial institution responsive to the region, not any single nation--offer for untangling sovereignty and regionhood, law and modernity, and postcolonial Caribbean identity? Joining the CCJ as an intern, Lee Cabatingan studied the work of the Court up close: she attended each court hearing and numerous staff meetings, served on committees, assisted with the organization of conferences, and helped to prepare speeches and presentations for the judges. She now offers insight into not only how the Court positions itself vis-à-vis the Caribbean region and the world, but also whether the Court--and, perhaps, the region itself as an overarching construct--might ever achieve a real measure of popular success. In their quest for an accepting, eager constituency, the Court is undertaking a project of extra-judicial region-building that borrows from the toolbox of the nation-state. The basic postulation of THE NEW CONSTITUTION MOVEMENT is that government and politics in St. Lucia, the OECS and the wider Caribbean needs to be reinvented for a post-postcolonial 21st-century society. The fact is, building a new 21st-century society on the wreckage of the old and decrepit postcolonial structures involves the design of new, more appropriate political systems which must be altogether tougher, more challenging, more positive, more ambitious, more inspirational, more generational and, above all, more transformational. This book shows how, through a process of social reengineering, we need to radically overhaul or even scrap many of the hitherto sacred cows of the colonially inherited Westminster system to the point that they may even lose some of their traditional meanings: the Monarchy, the Office of Governor-General, the Executive Branch, the Office of Prime Minister, the Cabinet System, the Legislative Branch, the Senate, the Office of Leader of the Opposition, the Political Parties, the Public Service, Local and Municipal Government, and last but not least, Regional Integration.
