Updated as of May 29, 2018 NMFS hereby amends the Capital Construction Fund (CCF) regulations to eliminate provisions that no longer meet the needs of CCF participants, and to simplify and clarify the regulations to better implement the purposes of the underlying statute. These amendments eliminate the minimum cost for reconstruction projects, requirements for minimum annual deposits and the requirement that any vessel acquired with CCF funds must be reconstructed, regardless of vessel condition. The new regulations also prohibit withdrawals of funds under the CCF program (program) for projects that increase harvesting capacity, unless the project is subject to a limited access system in which the fisheries management authority establishes harvesting limits. Book excerpt: This document contains the standards and procedures for operations and management of National Oceanic and Atmospheric Service (NOAA) small boats. For the purposes of The NOAA Small Boat Standards and Procedures Manual (the Manual), "small boats" are defined as vessels less than 300 gross tons. The Manual is designed to provide guidance, enhance safety and promote operational readiness by dictating general operating standards and procedures for all small boats operated under the authority of NOAA, including those based on Office of Marine and Aviation Operations (OMAO) ships. It is not intended to cover every contingency that may arise or every rule of safety in practice. At a minimum, this Manual incorporates the required provisions defined by NOAA Administrative Order (NAO) 209-125: The NOAA Small Boat Program, while also providing guidance specific to operations of NOAA small boats. All NOAA small boat operators, as well as employees and contractors involved in small boat operations, shall adhere to this Manual. This Manual may be augmented by a program's Supplemental Small Boat Policy (SSBP), however, the Supplemental Small Boat Policy can not diminish the minimum standards as set by the Manual or by NAO 209-125.

Prior to implementation of this final rule, all vessels issued an HMS Charter/Headboat permit could be categorized as commercial fishing vessels and could be subject to United States Coast Guard (USCG) commercial fishing vessel safety requirements regardless of whether the permit holder engages or intends to engage in commercial fishing. Under this final rule, HMS Charter/Headboat permit holders will be prohibited from selling Atlantic tunas, swordfish, or sharks unless they obtain a commercial sale endorsement for their permit. This final rule will clarify which HMS Charter/Headboat permitted vessels are properly categorized as commercial fishing vessels for purposes of USCG safety requirements. This action is administrative in nature and will not affect fishing practices or result in any significant environmental effects or economic impacts.
