Book The Management and Regulation of Occupational Pension Plans in Canada

Download or read book The Management and Regulation of Occupational Pension Plans in Canada written by Edward Tamagno and published by . This book was released on 2006 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The framework for the regulation of occupational pension plans The first formal step to regulate occupational pension plans in Canada was taken in 1946 when the Department of National Revenue, which at the time was the agency of the federal government responsible for the administration of the Income Tax Act, issued guidelines to determine whether a plan qualified for the preferential tax treatment [...] One of the conditions for obtaining this registration is that the plan also be registered with the provincial or federal agency responsible for the pension benefit law applicable to the plan, thus ensuring that occupational pension plans comply with all the requirements of the regulatory framework under both the tax and the pension benefit laws.6. [...] The titles of the relevant pension benefit laws and of the agencies responsible for overseeing their application are shown in Table 1. Designation of the plan administrator and the plan trustee The plan administrator is the person, group or entity responsible for managing the affairs of an occupational pension plan. [...] The solvency of the plan is determined as the aggregate of the market value of the plan assets and the present value of future special payments, over the liabilities of the plan where the liabilities are determined on a plan termination basis. [...] Rules regarding the investment of the assets of a plan The overriding objectives of pension benefit laws are to protect the interests of plan members and, in particular, to ensure that the plans will be able to pay the promised benefits when the pensions become due.

This edition tracks the shift of the law of trusts within pension jurisprudence from "classic" trusts to "modern" trusts; the reform of minimum pension standards; new plan design legislation being offered to respond to decreasing pension plan coverage among the Canadian workforce; the development of target benefit plans; and innovative plan designs such as New Brunswick's new "shared risk" plan model. The book will be an invaluable resource for anyone who needs to understand this complex legal and regulatory environment including lawyers, human resources officers, plan administrators and trustees, actuaries, accountants, public servants, and union officials.

Available in PDF, EPUB and Kindle. Book excerpt: Workplace pensions are a vital part of Canada’s retirement income system, but these plans have reached a state of crisis as a result of their low coverage and inadequate, insecure, and unequally distributed benefits. Reviewing pension plans through a legal and historical lens, Empty Promises reveals the paradoxical effects and inevitable failure of a pension system built on the interests of employers rather than employees. Elizabeth Shilton examines the evolution of pension law in Canada from the 1870s to the early twenty-first century, highlighting the foreseeably futile struggle of legislators to create and sustain employees’ pension rights without undermining employers’ incentives. The current system gives employers considerable discretion and control in pension design and administration. Shilton appeals for a model that is not hostage to business interests. She recommends replacing today’s employer-controlled systems with pensions shaped by the public interest, expanding mandatory broad-based or state-pension systems such as the Canada Pension Plan to generate pensions that respond to the changing workplace and address the needs and interests of retirees. Engaging with the long-running debate on whether Canadians should look to government or to the private sector for retirement income security, Empty Promises is a crucial work concerned with the future of the Canadian retirement system.

Book Retirement Policy Issues in Canada

Download or read book Retirement Policy Issues in Canada written by Michael G. Abbott and published by Queen's Policy Studies Series. This book was released on 2009 with total page 0 pages. Book excerpt: After fifteen years of economic expansion, Canada is now experiencing shortages of skilled workers in a number of areas - a mere hint of what's to come, given the eight-million plus baby boomers who will be retiring from the Canadian labour force over the next fifteen years or so. This on-coming wave of retirements will have major implications for the economic well-being of both the retirees - particularly since people are living longer after retirement - and the Canadian economy at large. In Retirement Policy Issues in Canada, contributors look at Canada's changing retirement landscape in broad terms. Chapters cover such topics as the direction of pension regulation in Canada, Canadian retirement patterns, retirement income replacement rates, challenges and policy options for an aging workforce, retirement incentives in defined benefit public and private pensions in Canada, key design features of defined benefit and defined contribution pension plans, recent legal and regulatory changes in pension plan design in Canada, options for older workers following job loss, management of longevity risks, sustainability of the Canada Pension Plan, mandatory retirement and private plan incentives, and the retirement prospects of immigrants.
