Book excerpt: This book examines African Americans' strategies for resisting white racial violence from the Civil War until the assassination of Martin Luther King, Jr., in 1968 and up to the Clinton era. Christopher Waldrep's semi-biographical approach to the pioneers in the anti-lynching campaign portrays African Americans as active participants in the effort to end racial violence rather than as passive victims. In telling this more than 100-year-old story of violence and resistance, Waldrep describes how white Americans legitimized racial violence after the Civil War, and how black journalists campaigned against the violence by invoking the Constitution and the law as a source of rights. He shows how, toward the end of the nineteenth century and into the twentieth, anti-lynching crusaders Ida B. Wells and Monroe Work adopted a more sociological approach, offering statistics and case studies to thwart white claims that a black propensity for crime justified racial violence. Waldrep describes how the NAACP, founded in 1909, represented an organized, even bureaucratic approach to the fight against lynching. Despite these efforts, racial violence continued after World War II, as racists changed tactics, using dynamite more than the rope or the gun. Waldrep concludes by showing how modern day hate crimes continue the lynching tradition, and how the courts and grass-roots groups have continued the tradition of resistance to racial violence. A rich selection of documents helps give the story a sense of immediacy. Sources include nineteenth-century eyewitness accounts of lynching, courtroom testimony of Ku Klux Klan victims, South Carolina senator Ben Tillman's 1907 defense of lynching, and the text of the first federal hate crimes law.

The approach of this book is in direct contrast with those that either view terrorism simplistically, as a clear reality threatening democratic society and thus requiring certain sorts of response, or argue, equally simplistically, that the invocation of terror is merely the ideological veil for continued capitalist exploitation. While closer in spirit to the second of these, this work does not simply dismiss the discourse on terror, but rather investigates the consequences of this discourse for the organisation of life in democratic societies. In interrogating the discourse of terror from a variety of viewpoints, this interdisciplinary text builds upon the understanding of the importance of the language of terror from a new perspective: the interconnections between discourses of terror; the material realities they at once reflect and help produce; and the specificities of particular historical circumstances. White (1869), the Supreme Court ruled that the unilateral secession of a state from the Union was unconstitutional because the Constitution created “an indestructible Union, composed of indestructible States.” The Court ruled “there was no place for reconsideration, or revocation, except through revolution, or through consent of the States.” In his iconoclastic work, Peter Radan demonstrates why the Court’s ruling was wrong and why, on the basis of American constitutional law in 1860–1861, the unilateral secessions of the Confederate states were lawful on the grounds that the United States was forged as a “slaveholders’ Union. Creating a More Perfect Slaveholders’ Union addresses two constitutional issues: first, whether the states in 1860 had a right to secede from the Union, and second, what significance slavery had in defining the constitutional Union. These two matters came together when the states seceded on the grounds that the system of government they had agreed to—namely, a system of human enslavement—had been violated by the incoming Republican administration. The legitimacy of this secession was anchored, as Radan demonstrates, in the compact theory of the Constitution, which held that because the Constitution was a compact between the member states of the Union, breaches of its fundamental provisions gave affected states the right to unilaterally secede from the Union. In so doing the Confederate states sought to preserve and protect their peculiar institution by forming a more perfect slaveholders’ Union. Creating a More Perfect Slaveholders’ Union stands as the first and only systematic analysis of the legal arguments mounted for and against secession in 1860–1861 and reshapes how we understand the Civil War and, consequently, the history of the United States more generally.

Focusing on independently-verified leading cases globally, a combination of qualitative and quantitative analysis offers the most comprehensive and systematic account of constitutional reasoning to date. This analysis is supported by the examination of eighteen legal systems around the world including the European Court of Human Rights and the European Court of Justice. Universally common aspects of constitutional reasoning are identified in this book, and contributors also examine whether common law countries differ to civil law countries in this respect.
