L'étude des contrats de licence internationaux disponibles à l'INPI nous permet d'avancer plusieurs résultats. Dans une première partie, nous montrons que les licences peuvent servir à pallier le déficit de protection institutionnelle. Il découle de cette analyse qu'il n'existe pas de relation simple entre le niveau de la protection institutionnelle à l'œuvre dans un pays et le nombre d'accords qui y est conclu. La deuxième partie permet de comparer l'efficacité des cadres institutionnels allemand, britannique et américain. Nous mobilisons tout d'abord la procédure d'Oaxaca (1973), pour mesurer les différences institutionnelles présentes entre ces pays. Nous menons ensuite une analyse semblable en prenant le test du temps comme critère d'efficience. Ces deux approches conduisent à des résultats opposés, et suggèrent donc qu'il existe des filtres perceptuels chez les partenaires français.
