En este punto no se trata de reconocer que la epistemología jurídica individual se centra en el proceso judicial, olvidando las etapas previas… sino de entender que, además, las instituciones son fenómenos sociales mediante los que toma forma una determinada política. En este caso, un sistema de controles epistémicos no solo debe gobernar las prácticas probatorias, sino impedir y dominar sus efectos socialmente injustos que se confirman a escala macro en el ámbito de la sociedad incluso cuando las instituciones (agencias de control social) parecen funcionar con normalidad. El libro La cadena de custodia de la prueba en el proceso penal, por tanto, se concibe sobre bases teórico-prácticas -en el limitado espacio de la cadena de custodia de las pruebas penales-, cuyo objetivo es reconocer, en una operación de reducción de complejidad, que, en el Estado de Derecho, la legitimación de la punición reclama la rigurosa adopción de un sistema de controles epistémicos que es esencial para la noción misma de debido proceso legal.
