Book excerpt: Article 7 TEU is unique in that it established the procedures for stating the threat of a breach of EU values by a Member States, the existence of such breach, as well as a possible sanctioning mechanism to bring the recalcitrant Member States back to compliance, while not being confined by the general EU competence limitations. This commentary outlines all the sub-instruments and stages of deployment of the provision in question in order to demonstrate Article 7 TEU eminent usability in the face of the claims by the Institutions to the contrary which are as baseless as they are persistent. The goal of this contribution is to explain the richness and significance of Article 7 TEU, thereby busting the unhelpful 'nuclear' myth about it. Such myth proclaims Article 7 TEU to be 'unusable' and is deployed by those in search of a valid pretext - however feeble - to exclude EU law from solving the Rule of Law crisis of the European Union. Two Member States, Hungary and Poland, are working hard, day and night, to undermine democracy, the Rule of Law and the protection of fundamental rights, i.e. the foundational values of the Union. The claims that EU law should not intervene are irresponsible and, ultimately, illegal.

Moreover, ongoing nuclear modernization programs in China and Russia point to the continued importance of nuclear deterrence and assurance for our allies and partners. Some countries now have military doctrines that include potential first use of nuclear weapons in a militarized crisis, and these countries regularly exercise those doctrines. These threats require the United States to seriously consider its responsibility to educate and advocate for the commitment and investment needed to sustain nuclear deterrence capabilities in a dangerous world.

Uranium enrichment has played a relatively quiet but important role in the history of efforts by a number of nations to acquire nuclear weapons and by a number of others to prevent the proliferation of nuclear weapons. For many years the uranium enrichment industry was dominated by a single method, gaseous diffusion, which was technically complex, extremely capital-intensive, and highly inefficient in its use of energy. As long as this remained true, only the richest and most technically advanced nations could afford to pursue the enrichment route to weapon acquisition. But during the 1970s this situation changed dramatically. Several new and far more accessible enrichment techniques were developed, stimulated largely by the anticipation of a rapidly growing demand for enrichment services by the world-wide nuclear power industry. This proliferation of new techniques, coupled with the subsequent contraction of the commercial market for enriched uranium, has created a situation in which uranium enrichment technology might well become the most important contributor to further nuclear weapon proliferation. Some of the issues addressed in this book are: A technical analysis of the most important enrichment techniques in a form that is relevant to analysis of proliferation risks; A detailed projection of the world demand for uranium enrichment services; A summary and critique of present institutional non-proliferation arrangements in the world enrichment industry, and An identification of the states most likely to pursue the enrichment route to acquisition of nuclear weapons.

It uses the Irish constitutional order to demonstrate that, right across the European Union, the national constitution can no longer be understood on its own, in isolation from the EU legal order or from the European Convention on Human Rights. The constitution is instead triangular, with these three legal orders forming the points of a triangle, and the relationship and interactions between them forming the triangle's sides. It takes as its starting point the theory of constitutional pluralism, which suggests that overlapping constitutional orders are not necessarily arranged 'on top of' each other, but that they may be arranged heterarchically or flatly, without a hierarchy of superior and subordinate constitutions. However, it departs from conventional accounts of this theory by emphasising that we must still pay close attention to jurisdictional specificity in order to understand the norms that regulate pluralist constitutions. It shows, through application of the theory to case studies, that any attempt to extract universal principles from the jurisdictionally contingent interactions between specific legal orders is fraught with difficulty. The book is an important contribution to constitutional theory in general, and constitutional pluralism in particular, and will be of great interest to scholars in the field.

Other uncertainties include the interest of major powers in developing a wider spectrum of nuclear weapons and delivery systems, possibly for use in limited nuclear wars, and the competitive technologies for antimissile defenses being developed and deployed by the United States and Russia. Other technology challenges, including the implications of cyberwar for nuclear deterrence and crisis management, are also considered. Political changes also matter. The early post-Cold War hopes for the emergence of a global pacific security community, excluding the possibility of major war, have been dashed by political conflict between Russia and NATO, by the roiled nature of American domestic politics with respect to international security, and by a more assertive and militarily competent China. Additionally, the study includes suggestions for both analysis and policy in order to prevent the renewed U.S.-Russian nuclear arms race and competition in new technologies. This volume would be ideal for graduate students, researchers, scholars and anyone who is interested in nuclear policy, international studies, and Russian politics.
