Book excerpt: Quite by accident, Roman law and English law share a peculiar dual structure. In both systems, the law (ius civile, Common law) was supported, amended and corrected by a second legal source (ius honorarium, Equity) found in the jurisdiction of particular magistrates. How did this dual structure come into being in Rome and England, and how did it influence legal developments? In Law & Equity: Approaches in Roman law and Common law, seven specialists explore the origins and consequences of this interaction. The history of equity and law is treated by Willem Zwalve, Paul Brand, David Ibbetson and Mike Macnair, while John Cartwright, Hendrik Verhagen, Frits Brandsma and Willem Zwalve offer a comparative legal history on issues of substantive law.

The impact of European law has increased considerably And The growing importance of environmental law has justified devoting a full chapter to this subject. Moreover, a continuous stream of case law and legislation has also necessitated updating the book. All these changes have led to important modifications as compared To The first two editions. For practical reasons, The order of the chapters has remained virtually unchanged. The 23 chapters in the book are divided into five parts: The Dutch Legal System, Private Law, Public Law, Labour Law and Legal Philosophy. In order to increase its usefulness for foreign students, The original --mainly Dutch-language--Bibliography has been extended to include a Bibliography of foreign publications on Dutch law. The editors have prepared this book under the auspices of the Netherlands Comparative Law Association. Many of the original contributors have collaborated in this revision; they have been joined by a new generation of comparative lawyers.

Book Choice of Law in Copyright and Related Rights

Download or read book Choice of Law in Copyright and Related Rights written by Mireille M. M. van Eechoud and published by Kluwer Law International B.V.. This book was released on 2003-01-01 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Nobody denies that the traditional territorial approach to copyright and other intellectual property rights has come under pressure. Yet it persists. Faced with the need to determine the applicable law in cross-border cases, lawyers everywhere wrestle with the implications of the territorial nature of copyright and related rights. In this book Mireille van Eechoud clears the way to the formulation of conflict rules that reflect the purpose of copyright law- to protect creators and stimulate the production and use of information- without reverting to old-fashioned notions of territoriality. She shows how the applicable law can be determined for four distinct legal avenues of intellectual property law: Which exclusive rights exist in an intellectual creation and for how long; Who is considered to own such right; How can these rights be transferred; and What continues infringement of copyright and related rights. Mireille van Eechoud shows how, when each of these questions is approached in the light of the different allocation principles used in modern choice of law, a new clarity begins to emerge that promises in time to build a set of conflict rules well suited to the unprecedented copyright and related rights issues that we find so difficult to resolve today. Her in-depth analysis draws in the classis multilateral conventions and treaties, underlying policies, technological and economic developments, utilitarian grounds versus justice considerations, and issues of infringement in the digital environment. Book The Democratic Paradox

Download or read book The Democratic Paradox written by Chantal Mouffe and published by Verso Books. This book was released on 2020-05-05 with total page 154 pages. Available in PDF, EPUB and Kindle. Book excerpt: From the theory of 'deliberative democracy' to the politics of the 'third way', the present Zeitgeist is characterized by attempts to deny what Chantal Mouffe contends is the inherently conflictual nature of democratic politics. Far from being signs of progress, such ideas constitute a serious threat to democratic institutions. Taking issue with John Rawls and Jrgen Habermas on one side, and the political tenets of Blair, Clinton and Schrder on the other, Mouffe brings to the fore the paradoxical nature of modern liberal democracy in which the category of the 'adversary' plays a central role. She draws on the work of Wittgenstein, Derrida, and the provocative theses of Carl Schmitt, to propose a new understanding of democracy which acknowledges the ineradicability of antagonism in its workings.

Book International Tax Planning and Prevention of Abuse

Download or read book International Tax Planning and Prevention of Abuse written by Luc De Broe and published by IBFD. This book was released on 2008 with total page 1146 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study considers how tax authorities attempt to strike down international tax avoidance structures, in particular those involving the use of conduit and base companies set up by third-country residents for purposes of "treaty shopping" and "EC-Directive shopping". The book focuses on the interaction between provisions and judicially developed doctrines of domestic tax law preventing international tax avoidance on the one hand, and norms of international law, in particular tax treaties and rules of Community law, on the other. It also considers treaty-based anti-avoidance measures such as the "beneficial ownership" requirement and "limitation on benefits" provisions. This part of the study compares and analyses the case law of Australia, Austria, Belgium, Canada, the Czech Republic, Finland, France, Germany, India, the Netherlands, Switzerland, the United Kingdom, and the United States.

Book Nazi Germany and the Jews

    Book Details:
  • Author : Saul Friedländer
  • Publisher : Harper Collins
  • Release : 2009-10-06
  • ISBN : 0061979856
  • Pages : 374 pages

Download or read book Nazi Germany and the Jews written by Saul Friedländer and published by Harper Collins. This book was released on 2009-10-06 with total page 374 pages. Available in PDF, EPUB and Kindle. Book excerpt: A great historian crowns a lifetime of thought and research by answering a question that has haunted us for more than 50 years: How did one of the most industrially and culturally advanced nations in the world embark on and continue along the path leading to one of the most enormous criminal enterprises in history, the extermination of Europe's Jews? Giving considerable emphasis to a wealth of new archival findings, Saul Friedlander restores the voices of Jews who, after the 1933 Nazi accession to power, were engulfed in an increasingly horrifying reality. We hear from the persecutors themselves: the leaders of the Nazi party, the members of the Protestant and Catholic hierarchies, the university elites, and the heads of the business community. Most telling of all, perhaps, are the testimonies of ordinary German citizens, who in the main acquiesced to increasing waves of dismissals, segregation, humiliation, impoverishment, expulsion, and violence.
