Excerpt: ...of exercising reasonable care that the appliances furnished them should be safe and suitable, can not be delegated so as to relieve the master from responsibility; and, so far as it is performed by others, the negligence of any servant, agent, or employee in the work is deemed not the negligence of a fellow-servant, but that of the master himself. We may assume, for the argument, that it was within the power of the defendant to have so conducted its business as to have made its trainmen both brakemen and car inspectors. But the question remains whether it did so in this case, and whether such is the effect and object of the rule promulgated. If a brakeman is to act as car inspector, he must have the expert skill and knowledge which a jury might find was necessary to discharge the duties of the latter position, and the defendant might find itself very much circumscribed in its appointment of trainmen. We think it quite plain that the defendant never intended to blend, nor has blended, the two distinct positions of brakeman and inspector. It appears that, as a mutter of fact, it has assumed to inspect cars at its terminus by servants especially designated for that purpose. The rule promulgated by the companv must have a reasonable construction. It imposed on the trainmen the obligation of examination of the appliances which their services compelled them to use, both for their own protection and the protection of the property of the master and the persons of their fellow-servants. The examination, however, was not necessarily to be that of an expert inspector, but such as the ordinary knowledge of brakemen, and the time allowed for the purpose consistent with their other duties, would enable them to make. Excerpt: ...jurisdiction for trial, and upon conviction shall be punished by a fine of not less than five nor more than one hundred dollars, or be sentenced to hard labor for a term not exceeding three months. Sec. 3. No child under the age of thirteen (13) years shall be employed at labor or detained in any factory or manufacturing establishment in this State fx'tween the hours of 7 p. m. and 6 a. ni. standard time, and no child under the age of sixteen (16) years shall be so employed or detained between said hours for more than fortyeight hours in any one week; and no child under the age of twelve shall be employed or detained in any factory or manufacturing establishment for more than sixty-six (66) hours in any one week. Sec. 4. Any person, persons or corporation or representative of such corporation who violates any of the provisions of this act, or who willfully or knowingly suffers or permits any child to be employed in violation of its provisions, shall be deemed guilty of a misdemeanor, and on conviction shall be punished by a fine of not more than ($200) two hundred dollars. Excerpt: ...we are satisfied that the fundamental principles of government declared by our bill of rights clearly and unequivocally prohibit legislation of the character of that involved in this case. Corporations--Liability Of Stockholders For Wages.--Section 41jlc8 of volume 3, Howell's Annotated Statutes of Michigan, provides that stockholders of manufacturing corporations "shall be individually liable for all labor performed for such corporations, which said liability may be enforced against any stockholder by action founded on this statute, at any time after an execution shall be returned unsatisfied in whole or in part against the corporation," etc. Under this statute suit was brought before a justice of the peace byRalph Kamp against Peter Wintermute, a stockholder in the Cheesman and Kelly Manufacturing Company, to recover for personal work and labor performed by Kamp for the company before Wintermute became a stockholder therein. The justice gave judgment for Kamp, and the cause was removed to the circuit court of Muskegon County by 3687--No. 4 7 writ of certiorari and there the judgment of the justice was reversed. The case was then carried to the supreme court of Michigan, which affirmed the judgment of the circuit court, holding that the statute in question does not make a stockholder liable for labor performed before he became a stockholder. The opinion of the supreme court was delivered by Judge Long, and is published in volume 65 of the Northwestern Keporter, pago 570. In the course of the opinion Judge Long said: It is conceded in this court that the defendant was not a stockholder in the corporation at the time the labor was performed; but, as shown on the trial before the justice, he was a stockholder at the time suit was...

Excerpt: ...each mine must have two openings suitably arranged for ingress and egress. Inflammable structures may not be built over these openings and no breaker may be built within 200 feet of them. Minute provision is mrde for ventilation, both as to the method of supplying the air and the quantity to be supplied, for the daily examination of dangerous places, for safety appliances in entering and leaving the mines, and for the inspection and care of machinery, besides some fifty-eight specific rules for the guidance of miners and employers, the value of which one unskilled in mining operations can not judge. To see that the provisions of the law are complied with eight inspectors are provided for. They are appointed by the governor on the recommendation of boards of examiners, of which there are three for the anthracite region. These boards are composed of three reputable miners in active practice and two reputable mining engineers, all appointed by the judges of certain county courts. The inspectors are charged with the further duty of keeping informed of the condition of the mines of their respective districts as to ventilation, machinery, drainage, method of lighting, use of lights, and so on, to investigate all accidents and report thereon, and to make all needed suggestions for providing for the health and safety of the employees. 1453--No. 13 6 Xo occasional inspection or regulations on paper can, however, take the place of intelligent supervision of the mines. Wallace's Administrator, 43 Southwestern Reporter, page 207.--This case was originally brought in the circuit court of Boyd County, Ky., against the J"1"e-nained company to recover damages for the death of one Grant Wallace who, while in the employ thereof as a track layer, was knocked down by slate which fell from the roof of a mine and so injured him that he finally died. A judgment was rendered in favor of the administrator, and the company appealed the case to the court of appeals of the State, which rendered its decision September 25,1897, and affirmed the judgment of the lower court. (Ashland Coal, Iron and Railway Company v. Wallace's Administrator, 42 Southwestern Reporter, page 744.) The company then filed a petition for a rehearing by the court of appeals and the court rendered its decision thereon November 18, 1897, and overruled the petition.
