This book examines its fascinating and turbulent development from the end of the 19th century to the present day and highlights its distinctive features from a comparative perspective. Its main goal is to foster a better understanding of the current messy state of Bulgarian private law - particularly the law of obligations and property law - and an appreciation for its rich heritage.00The book begins by reflecting on why the study of Bulgarian private law is worthwhile. Literature in the English language on East European laws, especially on Bulgarian law, is scarce. Beyond responding to a gap in knowledge, the author argues that research into Bulgarian law may challenge the traditional taxonomies of comparative law, enrich the understanding of the common law-civil law divide, showcase the importance of context in legal development, and help address the difficulties of harmonisation of law in the EU. Subsequently, the book provides an overview of the scattered sources of Bulgarian private law, since Bulgaria does not have a civil code. It also traces the turbulent history of Bulgarian private law over the past century and a half to shed light on how the unexpected vibrant patchwork observed today came to be, and shatters myths about Bulgarian law spread due to years of communist censorship. The author then explains the complex fabric of Bulgarian contract law which emerges from legislation, scholarly writing and case law, surveys the hazy realms of tort and unjust enrichment, and examines the fascinating transformations of the right to property which required the re-invention of property law twice over the past 100 years.

He was General Counsel of the University of Pennsylvania from 1975 to 1980. Professor Burbank is a member of the Executive Committee of the American Judicature Society, for which he also serves on the editorial committee, as chair of the amicus committee, and as co-chair of the Center for Judicial Independence Task Force. He has served as a Visiting Professor at the law schools of Goethe University (Frankfurt, Germany), Harvard University, the University of Michigan, and the University of Pavia (Italy). Barry Friedman (A.B. 1978, University of Chicago; J.D. 1982, Georgetown University) is a Professor of Law at New York University School of Law, where he writes and teaches in the areas of constitutional law, federal jurisdiction, and criminal procedure. Professor Friedman also practices law, both privately and pro bono, and has litigated in all levels of the state and federal courts, including on issues of judicial independence and federalism. Book excerpt: Axel Siedenberg, Lutz Hoffmann 1 The specificity of transformation in Ukraine When the Soviet empire collapsed in the very early 1990s, the new era that dawned was commonly given the name 'transformation', implying the systemic change from socialism towards some form of market economy. Almost ten years later, 'the' transformation process does not exist any more; instead, a whole variety of transformations are taking place in Eastern Europe and the CIS: Whereas some countries are heading towards EU membership (e. g. Poland), others are still pondering on what economic system to adopt (e. g. Russia) and yet others have rejected a market-oriented transformation outright (e. g. Belarus). Within this variety of transformations, Ukraine clearly stands out as a specific case: Whilst initially considered to be one of the stronger post-Soviet Republics, it descended into economic depression in 1992 and has hardly recovered since; on the other hand, once considered to be a potential centre of ethnic unrest and political instability, it has turned into a democratic, peaceful civil society that is firmly establishing itself within the new European and world order. This book takes a critical look at economic reform in Ukraine as compared to other East European and CIS countries. Our hypothesis is that Ukraine is going through a transformation process peculiar to itself, which can be traced at both macroeconomic and microeconomic level.

The Greek civil war that broke out at the end of World War II was one of the formative events in the early days of the Cold War. However, the factions that vied for influence over the state promoted their particular agendas with a vehemence, exclusiveness, and mistrust that destroyed any chance for genuine compromise and reconciliation. The essays collected here represent a systematic attempt to examine the domestic and external forces that were actively involved in the Greek civil war of the late 1940s and that contributed to its resolution. Specifically, they consider the political options available to postwar Greece by identifying the principal actors promoting such options and analyzing their programs, tactics, strengths, and weaknesses. They also highlight the close interaction among domestic, regional, and global levels of conflict and measure the impact of that conflict on the political development of Greece.

Book excerpt: In The Kremlin Playbook 2: The Enablers, the CSIS Europe Program and the Center for the Study of Democracy explored whether some of these jurisdictions and companies could be enabling forces that amplify Russian malign economic influence in some countries in Europe. The study analyzed the following case study countries: Austria, Czech Republic, Italy, Montenegro, the Netherlands, and Romania. The report shows that some countries facilitate or enable Russian malign economic influence, and by doing so these enablers actively participate in the weakening and discrediting of their own democratic structures. The Kremlin Playbook 2 concludes that Russian malign economic influence and illicit finance operate in a financial gray zone that is a clear and present danger to U.S. national security as well as transatlantic security. To push back against this threat, the United States and its European allies must take decisive action to limit Russia’s malign behavior in their financial systems. Only transparency and enforcement of our rule of law can guarantee trust in the system and rebuild confidence in democratic institutions.
