Book excerpt: La tesis de grado intenta demostrar que Administraciones y órganos públicos cuando actúan en el mercado relevante de los encargos públicos se encuentran vinculados por criterios de actuación similares a los que rigen a los agentes económicos privados. Sin embargo las cotas de eficiencia no se alcanzan en la práctica por lo que intentamos buscar una explicación a la ineficiencia de las compras públicas. De esta manera analizamos el deber de una administración llegando a la conclusión que el mismo prescribía comportamientos eficientes por parte de la administración lo que llevado a los procedimientos de selección de contratistas se traducía en cambiar el foco de análisis de los mismos, pasando a concebir aquéllos como un mecanismo de intercambio de información. Esta forma de analizar los procedimientos administrativos nos llevó a concluir que dos de las principales causas de que Administraciones y órganos públicos no sean lo eficiente que el deber de buena administración prescribe, lo encontramos en que los flujos de información que se intercambian en los procedimientos de selección de contratistas, se caracterizan por su asimetría en las relaciones entre los particulares y la Administración. Adicionalmente, llegamos a concluir que dada la estructura de la Ley de Contratos del Sector Público, aquélla permitía equilibrios colusorios lo que también podría ser una explicación del por qué Administraciones y órganos públicos no alcanzan los mandatos de eficiencia que impone el deber de buena administración.
