His father had been a Fellow of Oriel in the time of Arnold, Copleston, and Newman, and afterwards became Canon of Durham and Professor of Divinity and Ecclesias tical Literature in the Durham University. His mother was the eldest daughter of the Right Hon. Henry Hobhouse of Hadspen House, Somerset, Who was permanent Under Secretary of State for the Home Department from 1817 to 1827. He was a nephew, on his father's side, of Richard J enkyns, the well-known Master of Balliol, and, on his mother's side, of the present Lord Hobhouse. Lord Thring, Whose mother was an elder sister of Canon Jenkyns, was his first cousin, though be longing to an older generation. In recasting and rewriting the volume published in 1879, I have therefore attempted a deeper analysis of the subject which a more prolonged study of the cases rendered possible. In doing this I received many valuable suggestions from my friend Mr H. Duff of the Inner Temple. The volume published in 1881 reappears as chapters xii to xvi of the present work: these chapters preserve their original form, which kept convenience of reference principally in view. A considerable amount of information has been added to them, and many serious omissions have been supplied. To a member of the Reichsjustizamt at Berlin, one of the most erudite of German judges, Mr Landrichter Vierhaus, who has been my unwearying correspondent during the last eighteen months, I am indebted for much of this additional information, and for the entire chapter on German law.
