Book excerpt: In Small Claims Court there's only one winner... Don't let your opponent rake you over the coals. It happened to me. Burned like toast! Now I'm fighting back the best way I know how ... by showing you how to fight and win in small claims court. If you're like most honest folks, the closest you've ever come to a courtroom battle is watching two people slug it out in front of television's Judge Judy. But chances are that you have already been wronged by some someone. Like it or not, you are going to have to defend your honor and reputation in front of a judge. Here's just a small sample of what you'll discover the minute you start flipping through Brisk Justice ... * The two keys to a successful outcome in any court case (and no, hiring an attorney is not one of them). page 7 * Simple steps you can take to make the judge's life easier (helping the judge understand your case can make a huge difference in your favor). * How to rip apart your opponent's case (all perfectly legal ... $300 an hour attorneys do it every day). pages 58-60 * Five good reasons why you might want to settle out of court. (Hint: Even if you win the court battle, you could lose the war in other ways.) Read pages 96-99 to avoid making a big mistake! * The one thing you must never do in a court case (guaranteed ... if you miss this little detail, you'll go down in flames). The information in Brisk Justice is the super powerful ammunition you'll need to win in Small Claims Court. I believe in this book so much I proudly offer a money-back guarantee: You'll win your Small Claims Court case or this book is FREE. Just send me a message. I'll refund your money. Done and done. No questions asked. If you're being sued, theclock is already ticking. Get an answer to the court before the deadline or you lose. Here's more ... * Stupid little mistakes to avoid like the plague (make just one and you'll lose the case, hands down). * When and why you should bring your case to court even if the other party decides to settle at the last minute. Don't miss this little insurance policy on page 117. * Get all the lingo down pat - 19 legal terms you need to understand (they're not difficult ... just important). pages 13-16 * Bad checks are a pain in the butt. In small claims court you can get the bum to pay the original amount of the check plus additional money for damages ... if you know how to do this. Flip to page 88. * The only time you should ever raise an objection to your opponent's testimony and why you should never say objection, your honor! It's on page 153. * Verbal promises are contracts enforceable by law, but what I reveal about what's said after a written contract is signed will shock you! (Make sure you read this or you won't have a legal leg to stand on.) pages 62 and 69 * If you've been wronged you'll need to write a demand letter to the yellow dog. On pages 104-113 I show you how to write a legal and effective demand letter ... even if you flunked your creative writing course. I also show you how to write a killer response if you receive a demand letter. I include real samples. Way better than fill-in-the-blanks. * Why even a written contract is no guarantee you've got a winning case (it's a simple matter of law you need to know now!). If you're lucky, you'll be able to settle your differences the old fashioned way . with a handshake and an apology. Maybe it'll cost you a few bucks in theprocess. That's a BIG maybe. You see, today we live in a world where people end up in court over the least little thing. And once it gets to court it becomes a really big thing. If you're not up for the challenge, you could lose your shirt ... as well as your pride and your dignity. There's only one winner in a court battle. I'm here to help you come out on top.

Book excerpt: As heard on NPR's Fresh Air Recommended by The New York Times' Sam Roberts “Start Here is an urgent and timely primer on the approaches that are working and don’t require federal approval or political revolution to end one of the most pressing justice issues the country faces today.” —Brooklyn Daily Eagle A bold agenda for criminal justice reform based on equal parts pragmatism and idealism, from the visionary director of the Center for Court Innovation, a leader of the reform movement Everyone knows that the United States leads the world in incarceration, and that our political process is gridlocked. What can be done right now to reduce the number of people sent to jail and prison? This essential book offers a concrete roadmap for both professionals and general readers who want to move from analysis to action. In this forward-looking, next-generation criminal justice reform book, Greg Berman and Julian Adler of the Center for Court Innovation highlight the key lessons from these programs—engaging the public in preventing crime, treating all defendants with dignity and respect, and linking people to effective community-based interventions rather than locking them up. Along the way, they tell a series of gripping stories, highlighting gang members who have gotten their lives back on track, judges who are transforming their courtrooms, and reformers around the country who are rethinking what justice looks like. While Start Here offers no silver bullets, it does put forth a suite of proven reforms—from alternatives to bail to diversion programs for mentally ill defendants—that will improve the lives of thousands of people right now. Start Here is a must-read for everyone who wants to start dismantling mass incarceration without waiting for a revolution or permission. Proceeds from the book will support the Center for Court Innovation's reform efforts.

Available in PDF, EPUB and Kindle. Book excerpt: Fifty years after President Dwight D. Eisenhower ordered troops to Little Rock, Arkansas, to enforce a federal court order desegregating the city's Central High School, a leading authority on Eisenhower presents an original and engrossing narrative that places Ike and his civil rights policies in dramatically new light. Historians such as Stephen Ambrose and Arthur Schlesinger, Jr., have portrayed Eisenhower as aloof, if not outwardly hostile, to the plight of African-Americans in the 1950s. It is still widely assumed that he opposed the Supreme Court's landmark 1954 Brown v. Board of Education decision mandating the desegregation of public schools, that he deeply regretted appointing Earl Warren as the Court's chief justice because of his role in molding Brown, that he was a bystander in Congress's passage of the civil rights acts of 1957 and 1960, and that he so mishandled the Little Rock crisis that he was forced to dispatch troops to rescue a failed policy. In this sweeping narrative, David A. Nichols demonstrates that these assumptions are wrong. Drawing on archival documents neglected by biographers and scholars, including thousands of pages newly available from the Eisenhower Presidential Library, Nichols takes us inside the Oval Office to look over Ike's shoulder as he worked behind the scenes, prior to Brown, to desegregate the District of Columbia and complete the desegregation of the armed forces. We watch as Eisenhower, assisted by his close collaborator, Attorney General Herbert Brownell, Jr., sifted through candidates for federal judgeships and appointed five pro-civil rights justices to the Supreme Court and progressive judges to lower courts. We witness Eisenhower crafting civil rights legislation, deftly building a congressional coalition that passed the first civil rights act in eighty-two years, and maneuvering to avoid a showdown with Orval Faubus, the governor of Arkansas, over desegregation of Little Rock's Central High. Nichols demonstrates that Eisenhower, though he was a product of his time and its backward racial attitudes, was actually more progressive on civil rights in the 1950s than his predecessor, Harry Truman, and his successors, John F. Kennedy and Lyndon Johnson. Eisenhower was more a man of deeds than of words and preferred quiet action over grandstanding. His cautious public rhetoric -- especially his legalistic response to Brown -- gave a misleading impression that he was not committed to the cause of civil rights. In fact, Eisenhower's actions laid the legal and political groundwork for the more familiar breakthroughs in civil rights achieved in the 1960s. Fair, judicious, and exhaustively researched, A Matter of Justice is the definitive book on Eisenhower's civil rights policies that every presidential historian and future biographer of Ike will have to contend with.

Download or read book Twelve Good Men and True written by J. S. Cockburn and published by Princeton University Press. This book was released on 2014-07-14 with total page 433 pages. Available in PDF, EPUB and Kindle. Book excerpt: Twelve Good Men and True brings together some of the most ambitious and innovative work yet undertaken on the history of an English legal institution. These eleven essays examine the composition of the criminal trial jury in England, the behavior of those who sat as jurors, and popular and official attitudes toward the institution of jury trial from its almost accidental emergence in the early thirteenth century until 1800. The essays have important implications for three problems central to the history of criminal justice administration in England: the way in which the medieval jury was informed and reached its verdict; the degree and form of independence enjoyed by juries during the early modern period when the powers of the bench were very great; and the role of the eighteenth-century trial jury, which, although clearly independent, was, by virtue of the status and experience of its members, arguably a mere extension of the bench. This extensive collection marks the first occasion on which scholars working in several different time periods have focused their attention on the history of a single legal institution. Written by J. M. Beattie, J. S. Cockburn, Thomas A. Green, Roger D. Groot, Douglas Hay, P.J.R. King, P. G. Lawson, Bernard William McLane, J. B. Post, Edward Powell, and Stephen K. Roberts, the essays utilize sophisticated techniques to establish from a variety of manuscript sources the wealth, status, and administrative experience of jurors. Originally published in 1988. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions. The goal of the Princeton Legacy Library is to vastly increase access to the rich scholarly heritage found in the thousands of books published by Princeton University Press since its founding in 1905.

Written with unique authority and perspective, The Court and the World reveals an emergent reality few Americans observe directly but one that affects the life of every one of us. Here is an invaluable understanding for lawyers and non-lawyers alike.
