Abstract: ABSTRACT Comparative studies of anti-corruption law between Hong Kong and China WANG Wai-hong Kenny By comparing the anti-corruption laws between Hong Kong and China specifically on government servants, it is argued that the Chapter 8 of the Criminal Law of China, Crimes of Embezzlement and Bribery, has room for improvement. The Prevention of Bribery Ordinance of Hong Kong can offer some useful hints to improve the Chapter 8 of the Criminal Law and make it more powerful to combat corruption in China. Available in PDF, EPUB and Kindle. Book excerpt: The Bribery Act 2010 is the most significant reform of UK bribery law in a century. This critical analysis offers an explanation of the Act, makes comparisons with similar legislation in other jurisdictions and provides a critical commentary, from both a UK and a US perspective, on the collapse of the distinction between public and private sector bribery. Drawing on their academic and practical experience, the contributors also analyse the prospects for enforcement and the difficulties facing lawyers seeking asset recovery following the laundering of the proceeds of bribery. International perspectives are provided via comparisons with the law in Spain, Hong Kong, the USA and Italy, together with broader analysis of the application of the law in relation to EU anti-corruption initiatives, international development and the arms trade.

Available in PDF, EPUB and Kindle. Book excerpt: Corruption ran rampant in Hong Kong until the establishment of the Independent Commission Against Corruption (ICAC) in 1974, the world's largest anti-corruption body. Armed with draconian powers, the Commission quickly scored notable successes in combatting corruption. This book examines the history and nature of corruption in the Colony both before and after the ICAC was established-the cases celebres of the past and their bizarre cast of characters, the riots and the retaliations. Lethbridge also analyzes the impact of the ICAC on the public and private sectors in Hong Kong.

Book Corruption Prevention and Governance in Hong Kong

Download or read book Corruption Prevention and Governance in Hong Kong written by Ian Scott and published by Routledge. This book was released on 2018-12-07 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses central questions in the continuing debate about success factors in corruption prevention and the efficacy and value of anti-corruption agencies (ACAs). How do ACAs become valued within a polity? What challenges must they overcome? What conditions account for their success and failure? What contributions can corruption prevention make to good governance? And in what areas might they have little or no effect on the quality of governance? With these questions in mind, the authors examine the experience of Hong Kong’s Independent Commission Against Corruption (ICAC), widely regarded as one of the few successful examples of an ACA. The book is grounded in an analysis of ICAC documents and surveys, the authors’ survey of social attitudes towards corruption in Hong Kong, and interviews with former officials.

Book Corruption Integrity and Law Enforcement

Download or read book Corruption Integrity and Law Enforcement written by Cyrille J.C.F. Fijnaut and published by BRILL. This book was released on 2021-08-04 with total page 480 pages. Available in PDF, EPUB and Kindle. Book excerpt: Integrity and corruption have become important issues in the practice and theory of politics, public administration, law, economics and social life. Consequently, they have also become significant topics for law enforcement organisations. Indeed, these organisations play a crucial role in the struggle against corruption in society, and, in order to do that, their own integrity must be beyond doubt. This volume, with contributions by 35 authors from 13 countries in five continents, offers a comprehensive overview of "corruption, integrity and law enforcement". The related papers were presented at the Second Global Forum on Fighting Corruption and Safeguarding Integrity that took place in The Hague in May 2001. The content and extent of the problem of corruption are presented via case studies from individual countries. Furthermore, corruption and integrity in the law enforcement system itself are highlighted, and the legal instruments that are available to combat corruption and to safeguard integrity are discussed. Special attention is paid here to independent institutions that operate in several countries. Finally, several contributions focus on the global dimension of the subject: the international organisations and initiatives that play an important role in the world-wide struggle against corruption. This volume is therefore of great relevance for policy makers and academic researchers, as well as for practitioners.

Book Corruption by Design

Download or read book Corruption by Design written by Melanie Manion and published by Harvard University Press. This book was released on 2009-07-01 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contrasts experiences of mainland China and Hong Kong to explore the pressing question of how governments can transform a culture of widespread corruption to one of clean government. Melanie Manion examines Hong Kong as the best example of the possibility of reform. Within a few years it achieved a spectacularly successful conversion to clean government. Mainland China illustrates the difficulty of reform. Despite more than two decades of anticorruption reform, corruption in China continues to spread essentially unabated. The book argues that where corruption is already commonplace, the context in which officials and ordinary citizens make choices to transact corruptly (or not) is crucially different from that in which corrupt practices are uncommon. A central feature of this difference is the role of beliefs about the prevalence of corruption and the reliability of government as an enforcer of rules ostensibly constraining official venality. Anticorruption reform in a setting of widespread corruption is a problem not only of reducing corrupt payoffs, but also of changing broadly shared expectations of venality. The book explores differences in institutional design choices about anticorruption agencies, appropriate incentive structures, and underlying constitutional designs that contribute to the disparate outcomes in Hong Kong and mainland China.
