Book Illinois Boundary Law

Download or read book Illinois Boundary Law written by Jeffery N. Lucas and published by . This book was released on 2012 with total page 628 pages. Available in PDF, EPUB and Kindle. Book excerpt: Illinois Boundary Law is the essential reference book for anyone who needs to understand real property boundaries under Illinois law. Written primarily for land surveyors, this book is also a valuable tool for real estate professionals, attorneys, and landowners. Arranged in eleven chapters, the subject matter includes the origination of real property title in the State of Illinois, how real property boundaries are established on the ground, deeds, conveyances, surveying systems, easements, and rights-of-way. Written in a similar fashion to a law school casebook, there are plenty of court opinions, excerpts from cases and citations to actual lawsuits involving boundary disputes, adverse possession, negligence actions, trespass issues and slander of title, to name a few. Cases from other jurisdictions have been included on points where Illinois' courts have been silent. This book is an intriguing read for anyone interested in the history and development of real property boundaries in Illinois.

Book Georgia Land Surveying History and Law

Download or read book Georgia Land Surveying History and Law written by Farris W. Cadle and published by University of Georgia Press. This book was released on 1991 with total page 597 pages. Available in PDF, EPUB and Kindle. Book excerpt: Georgia Land Surveying History and Law is the first definitive history and analysis of Georgia’s land system and the laws that govern it. The book’s opening section tells the story of the surveyor’s role in transforming Georgia from a frontier to a bounded, populated, and productive colony and state. Paced by anecdotes of surveyors’ wilderness experiences, the narrative traces the evolution of Georgia’s land subdivision system, beginning with the original, and ultimately impractical, scheme of land granting and rectangular land subdivision under the Trustees of the Georgia Colony. The volume then covers the more flexible but easily abused headright procedure, and the subsequent lottery and succession of systematic, rectangular surveys under which most of the state was laid out and granted in the early nineteenth century. Finally, in lay terms supported by meticulous citation of authority, the volume discusses the legal aspects of land surveying, including the interests that make up land ownership, the transfer of real property, the interpretation of property descriptions, the location of boundaries, riparian and littoral rights, and other topics. The book examines every point concerning boundaries found in any Georgia case or statute. Based solidly on primary sources and the author’s fifteen years of experience in land surveying and title abstracting, Georgia Land Surveying History and Law is an exhaustively researched and scholarly reference that will be useful to surveyors, title attorneys, title abstractors, real estate professionals, geographers, cartographers, historians, and genealogists.

Book The Pincushion Effect

Download or read book The Pincushion Effect written by Jeffery N. Lucas and published by . This book was released on 2011 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: American land surveying has a dilemma; it's called the "pincushion corner." This is a name used to describe the phenomena of multiple boundary monuments being set by land surveyors when only one boundary corner exists under the law. The pincushion has not gone unnoticed by the legal profession and the general public. It is now common knowledge that no two surveyors can agree on the location of any given property corner. The pincushion is physical proof of that notion. Not only is the pincushion becoming a public relations disaster for the profession, it is causing those who might otherwise consider commissioning a survey to decide otherwise. And herein lies the dilemma; no one wants to hire the surveyor because of the way surveying is practiced, the pincushion being emblematic of that practice. This book explores the effect of the pincushion, how the phenomena started, why it exists, and remedies to end the practices that allow the pincushion corner to not only exist, but to flourish.
