Book excerpt: Dr Peng He in her book addresses various issues, drawing on Western and Chinese sources for her argument for a ‘communicative’ theory of law making. This book is both timely and important in the Chinese context. Her argument depends upon the insight that what is important in societies is not just representative democracy but ‘voice’ - the opportunity for individuals to be heard and bring their input into official systems. More than that, she argues that this can also take further the idea of living by the rules as something that is not to be seen as narrow Legalism but as something more akin to living ‘righteously’ – a view which is resonant with parts of Chinese legal thought. This book is also important in the present Chinese context in another way. The developing economy necessitates substantial legal reform. But applying Western models to China can often be naïve and not fully fulfil their intended purpose. Peng He’s work addresses this by looking at the process of legislation in connection with legal reform. It is grounded in a sound theoretical reflection of both the process of legal transplantation and the process of law making, and looks both at Western and Chinese sources. Such an approach needs to draw from several intellectual traditions and it is this interdisciplinary, foundational research that is the task Dr He has set herself in her project. Her theory will provide an abstract theoretical framework that is sensitive to local conditions, while at the same time incorporating insights on law reform from a broad range of disciplines. The peninsular geo-body gives rise to the politics of singularity as seen in the case of the predominant monolingual culture in Thailand, whereas the archipelagic geography such as the thousand islands of Indonesia allows for peculiar types of communication. Translation can also be metaphorized poetically to configure the transference in different scenarios such as the cases of self-translation in Philippine protest poetry and untranslatability in Vietnamese diasporic writings. The collection also includes intra-regional comparative views on historical and religious terms. She is particularly interested in the power of wandering or daydreaming for those whose mobility has been under severe constraint, from the slave era to the present. Since the Enlightenment, wandering has been considered dangerous and even criminal when associated with people of color. Cervenak engages artist-philosophers who focus on wayward movement and daydreaming, or mental travel, that transcend state-imposed limitations on physical, geographic movement. From Sojourner Truth's spiritual and physical roaming to the rambling protagonist of Gayl Jones's novel Mosquito, Cervenak highlights modes of wandering that subvert Enlightenment-based protocols of rationality, composure, and upstanding comportment. Turning to the artists Pope.L (William Pope.L), Adrian Piper, and Carrie Mae Weems, Cervenak argues that their work produces an otherworldly movement, an errant kinesis that exceeds locomotive constraints, resisting the straightening-out processes of post-Enlightenment, white-supremacist, capitalist, sexist, and heteronormative modernity. Their roaming animates another terrain, one where free, black movement is not necessarily connected to that which can be seen, touched, known, and materially valued.

Book excerpt: Slavery After Rome, 500-1100 offers a substantially new interpretation of what happened to slavery in Western Europe in the centuries that followed the fall of the Roman Empire. The periods at either end of the early middle ages are associated with iconic forms of unfreedom: Roman slavery at one end; at the other, the serfdom of the twelfth century and beyond, together with, in Southern Europe, a revitalised urban chattel slavery dealing chiefly in non-Christians. How and why this major change took place in the intervening period has been a long-standing puzzle. This study picks up the various threads linking this transformation across the centuries, and situates them within the full context of what slavery and unfreedom were being used for in the early middle ages. This volume adopts a broad comparative perspective, covering different regions of Western Europe over six centuries, to try to answer the following questions: who might become enslaved and why?
