Book excerpt: "For the actions described in this document, the action agencies are the United States Navy, which proposes to undertake training activities in operating areas and range complexes along the Atlantic Coast of the United States of America and NMFS' Office of Protected Resources - Permits, Conservation, and Education Division, which proposes to issue Letters of Authorization that would authorize the U.S. Navy to 'take' marine mammals incidental to those activities. The consulting agency for these proposals is NMFS' Office of Protected Resources - Endangered Species Division. This document presents the results of section 7 consultations on several actions that are all proposed to occur along the Atlantic Coast of the United States: (1) the U.S. Navy's proposal to conduct training activities in (a) the Northeast Operating Area; (b) the Virginia Capes Range Complex; (c) the Cherry Point Range Complex; and (d) the Jacksonville Range Complex from June 2010 to June 2011; and (2) the National Marine Fisheries Service's Permits, Conservation, and Education Division's (Permits Division) proposal to issue an annual Letter of Authorization to the U.S. Navy to 'take' marine mammals incidental to the conduct of training in the Virginia Capes, Cherry Point, and Jacksonville Range Complexes for a one-year period beginning in June 2010 and ending in June 2011. The National Marine Fisheries Service's biological opinions on each of these separate actions have been grouped into this single document because of their spatial proximity and their potential to result in cumulative impacts (in the NEPA sense of that term) on endangered and threatened species and designated critical habitat that occurs along the Atlantic Coast of the United States."--[Page 2]. Updated as of May 29, 2018 Upon application from the U.S. Navy (Navy), we (the National Marine Fisheries Service) are issuing regulations under the Marine Mammal Protection Act (MMPA) to govern the unintentional taking of marine mammals incidental to training and testing activities conducted in the Hawaii-Southern California Training and Testing (HSTT) Study Area from December 2013 through December 2018. These regulations allow us to issue Letters of Authorization (LOAs) for the incidental take of marine mammals during the Navy's specified activities and timeframes, set forth the permissible methods of taking, set forth other means of effecting the least practicable adverse impact on marine mammal species or stocks and their habitat, and set forth requirements pertaining to the monitoring and reporting of the incidental take.
