The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The questions are approached by investigating the responses of Lake Babine First Nation women to such questions and comparing this information with published analyses of women and First Nations governance. The final paper examines the history & rationale for the section 67 exemption of Indian Act matters from the Canadian Human Rights Act in the context of First Nations women's equality interests in governance. It reviews barriers to full realization of First Nations women's equality rights, particularly issues relating to Indian status & the band membership entitlement system, and decision-making by Indian Act band councils that reflects the arbitrary legal distinctions made in the Act.

Book excerpt: In 2005 an expert group representing the governments of Norway, Sweden and Finland, and the Saami parliaments of these countries agreed upon a draft text of a Nordic Saami Convention. Key parts of the text deal with the recognition of Saami land and resource rights. More recently the three governments have embarked on negotiations to move from this draft text to a final convention that may be adopted and ratified by all three countries. Negotiations commenced in the Spring of 2011 and should be completed within five years. This collection of essays explores the national and international dimensions of indigenous property rights and the draft Convention which recognises the Saami as one people divided by international boundaries. Part one of the book seeks to provide a global and theoretical context for these developments in the Nordic countries, with a series of essays dealing with the moral and legal reasons for recognising indigenous property interests and different conceptualisations of the relationship between indigenous peoples and settler societies, including recognition, reconciliation and pluralism. Part two of the book examines some international legal issues associated with the Convention, including the background to the Convention. Part three turns to examine aspects of the recognition of Saami property interests in each of the three Nordic states, while Part four provides some comparative experiences, examining the recognition of indigenous property rights in a number of jurisdictions, including Canada, Australia and a number of South American states. An additional essay considers gender issues in relation to indigenous property rights.

[...] On 11 May 2010, the Speaker of the House of Commons ruled that the amendment to clause 2 exceeded the scope of the bill and was therefore inadmissible. [...] The bill was also amended to include a provision requiring the Minister of Indian Affairs and Northern Development to report to Parliament on the provisions and implementation of the bill within two years of its coming into effect. [...] In the wake of the Lavell ruling, Indian Rights for Indian Women and the Native Women's Association of Canada were especially active advocates, lobbying parliamentarians and government for immediate and longer-term remedies.15 The government acknowledged the need to eliminate gender discrimination under the Act, but considered that amendments should occur in the context of broader revision after c [...] McIvor and her son challenged the Act's post-Bill C-31 registration provisions as discriminatory on the basis of sex and marital status under sections 15 and 28 of the Canadian Charter of Rights and Freedoms, in that they continued to favour the male line in the transmission of status to descendants born before 1985.40 In June 2007, the British Columbia Supreme Court agreed, and declared section 6.

Many iterations of the legislation conferred a woman’s status rights through marriage, and even once it was amended First Nations women could not necessarily pass their status on to their descendants. What has that injustice meant for First Nations men? Martin J. Cannon challenges a decades-long assumption that the act has affected Indigenous people as either “women” or “Indians” – but not both. He argues that sexism and racialization within the law must instead be understood as interlocking forms of discrimination that disrupt gender complementarity and undercut the identities of Indigenous men through their female forebears.
