Book Trade Barriers to the Public Good

Download or read book Trade Barriers to the Public Good written by Alex C. Michalos and published by McGill-Queen's Press - MQUP. This book was released on 2008 with total page 431 pages. Available in PDF, EPUB and Kindle. Book excerpt: The North American Free Trade Agreement (NAFTA) and the Agreement on Internal Trade (AIT) were designed to strengthen investor's rights at the expense of community rights and environmental protection. Both deals have achieved their aims. Trade Barriers to the Public Good provides a detailed examination of NAFTA and AIT cases involving MMT - a chemical additive brought into Canada by the US company Ethyl Corporation Inc. When the Canadian federal government banned the importation of MMT under the Fuel Additives Act, Ethyl Corp. filed a claim under NAFTA Chapter 11 seeking US $201 million in damages. Alex Michalos uses a case study of MMT to reveal exactly how and why quasi-judicial international dispute processes provide significantly less protection for the public interest than the routine procedures for passing an ordinary Act of Parliament.Trade Barriers to the Public Good illustrates why and how constitutionally protected democratic rights are undermined by trade deals such as the one involving MMT and, failing termination of NAFTA and AIT - the author's first choice for remedial action - recommends precise changes in dispute settlement rules that are needed to protect individuals and the environment.

This book was released on 2012-06-22 with total page 601 pages. Available in PDF, EPUB and Kindle. Book excerpt: “Marine transport, and the law and policy within which it operates, must be seen as very similar to other international undertakings operating on a transnational scale.” These concluding words in Edgar Gold’s Maritime Transport (Lexington, 1981) aptly capture the past, present and future of the regulation of international shipping. The Regulation of International Shipping: International and Comparative Perspectives in Honor of Edgar Gold pays tribute to a mariner, legal practitioner and university teacher with a unique understanding of shipping and maritime trade. With diverse disciplinary backgrounds and perspectives, the distinguished contributors to this tribute examine the public law and policy framework for international navigation, the complex relationship between shipping and the marine environment, the imperative of better protection of seafarers, and ultimately, responsible ocean use. Book In the Chamber of Risks

Download or read book In the Chamber of Risks written by William Leiss and published by McGill-Queen's Press - MQUP. This book was released on 2001 with total page 405 pages. Available in PDF, EPUB and Kindle. Book excerpt: In In the Chamber of Risks William Leiss demonstrates that case studies of risk controversies show that those instincts are unreliable guides to effective risk management and that in all cases the opposite position is a far better guide. As risk management is inherently disputable, public perceptions of risk should be seen as legitimate and treated as such and the public should always be involved in discussions about risk evaluations made by scientists and risk managers. ; Leiss chronicles the erratic course of risk management and communication in environmental management in Canada, discussing the notable controversies that have arisen over pesticides and breast cancer, vinyl toys, genetically engineered food crops, cellular telephones, and antibiotic-resistant bacteria, among many others. He focuses on risk management - how we make decisions about and assess hazards in the environment - and on risk communication - social dialogue that deals with both our intuitive feelings of concern about substances or activities that might hurt our health or the environment, and the scientific and probabilistic description of them. ; Leiss shows that both risk management and risk communication, when properly constructed, require an elaborate process because the very things that can cause harm are in most cases the same things that bring us great benefits, such as paper mills, electricity from nuclear power generating stations, or wireless telecommunications. ;
