Book Common Law Civil Law and Colonial Law

Download or read book Common Law Civil Law and Colonial Law written by William Eves and published by Cambridge University Press. This book was released on 2021-04-15 with total page 349 pages. Available in PDF, EPUB and Kindle. Book excerpt: Common Law, Civil Law, and Colonial Law builds upon the legal historian F.W. Maitland's famous observation that history involves comparison, and that those who ignore every system but their own 'hardly came in sight of the idea of legal history'. The extensive introduction addresses the intellectual challenges posed by comparative approaches to legal history. This is followed by twelve essays derived from papers delivered at the 24th British Legal History Conference. These essays explore patterns in legal norms, processes, and practice across an exceptionally broad chronological and geographical range. Carefully selected to provide a network of inter-connections, they contribute to our better understanding of legal history by combining depth of analysis with historical contextualization. This title is also available as Open Access on Cambridge Core.

Book Charles Areskine s Library

Download or read book Charles Areskine s Library written by Karen Baston and published by BRILL. This book was released on 2016-04-26 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Charles Areskine’s Library, Karen Baston uses a detailed study of an eighteenth-century Scottish advocate’s private book collection to explore key themes in the Scottish Enlightenment including secularisation, modernisation, internationalisation, and the development of legal literature in Scotland. By exploring a surviving manuscript dated 1731that lists a Scottish lawyer’s library, Karen Baston demonstrates that the books Charles Areskine owned, used in practice, and read for pleasure embedded him in the intellectual culture that expanded in early eighteenth-century Scotland. Areskine and his fellow advocates emerged as scholarly and sociable gentlemen who led their nation. Lawyers were integral to and integrated with the Scottish society that allowed the Scottish Enlightenment to take root and flourish within Areskine’s lifetime.

With Sir Thomas Egerton's Additions. Edited From Manuscripts in the Huntington Library. San Marino: Huntington Library, 1942. vii, 194 pp. Reprinted 2004 by The Lawbook Exchange, Ltd. Written anonymously at the end of the Year Book period, the Discourse Upon the Exposicion and Understandinge of Statutes is the earliest English treatise on the subject. Thorne's edition has the additional appeal of lengthy manuscript notes compiled from a copy owned by Sir Thomas Egerton [?1540-1617], an attorney who held several important posts in Elizabethan England including Solicitor-General and Lord Chancellor. "Professor Thorne ... has carried out his difficult task with great skill and has prefixed an introduction which can be regarded as the most authoritative and most richly documented discussion as yet upon the problems of statutory interpretation from the later fourteenth century ... to the age of Coke." T.F.T. Plucknett, Law Quarterly Review 60:242 cited in Marke, A Catalogue of the Law Collection at New York University (1953) 810.
