Book The Earth on Trial

Download or read book The Earth on Trial written by Paul Stanton Kibel and published by Routledge. This book was released on 2002-06-01 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Earth on Trial examines the degree to which the law has accommodated an increased understanding of the natural environment. Paul Stanton Kibel provides a clear assessment of what conceptual and practical changes are needed to reconcile law to the limits of ecology. By moving the debate between law and the environment beyond specialists, and towards a public forum, The Earth on Trial acknowledges that a healthy environmental future depends not so much on our ability to alter nature to accommodate society, as our ability to alter society to accommodate nature.

Book International Environmental Laws and Regulations

Download or read book International Environmental Laws and Regulations written by Dennis Campbell and published by Wiley. This book was released on 1996-08-01 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: The quality of water, air and soil continues to decline. Poverty, population growth and unregulated industry combine to create pollution on an unprecedented scale. Yet despite overwhelming support for the Rio Declaration in 1992, international response to the crisis in the environment has been piecemeal and uneven. The developing canon of international environmental law is of vital importance to lawyers, decision-makers and environmental advocates. Practical lessons can be drawn from the range of approaches being taken to such universal issues as pollution control, liability and waste management. Familiarity with international case law and judicial decision-making can support and develop legal argument. International Environmental Law and Regulations draws together expert practitioners from Argentina, Belgium, Canada, England & Wales, France, Greece, Italy, Mexico, Norway, Scotland and Singapore to provide a statement of the progress of environmental regulation in their jurisdictions. The practical analysis includes coverage of: the application of international and Community law national, regional and local regulation leading case law trends in judicial decision-making civil and criminal liability As a source of instructive information and ideas, the book will be of value to specialists in environmental law, in-house lawyers in industry, environmental advocates and academic lawyers.

Book excerpt: Environmental law and regulation is a global as well as a national concern and lawyers and environmentalists need to fully understand the legal framework of different jurisdictions. This is the second volume in a trilogy of titles dedicated to serve these needs, the first of which published in 1996. This volume contains topical accounts and analysis of environmental control in the following countries: Australia, Austria, Bulgaria, England and Wales, Germany, Hong Kong, Italy, Korea, New Zealand, Nigeria, South Africa and US, as well as chapters on international environmental issues. As a source of instructive information and ideas, of in-depth national reports and with chapters on specific issues, International Environmental Law and Regulations, Volume 2 will be of value to environmental lawyers and environmentalists alike.

Book excerpt: Several major statutes form the legal basis for the programs of the Environmental Protection Agency (EPA). Many of these have been amended several times. The current provisions of each are briefly summarised in this report. The Pollution Prevention Act (PPA) seeks to prevent pollution through reduced generation of pollutants at their point of origin. The Clean Air Act (CAA) requires EPA to set mobile source limits, ambient air quality standards, hazardous air pollutant emission standards, standards for new pollution sources, and significant deterioration requirements; and to focus on areas that do not attain standards. The Clean Water Act (CWA) establishes a sewage treatment construction grants program, and a regulatory and enforcement program for discharges of wastes into U.S. waters. Focusing on the regulation of the intentional disposal of materials into ocean waters and authorising related research is the Ocean Dumping Act. The Safe Drinking Water Act (SDWA) establishes primary drinking water standards, regulates underground injection disposal practices, and establishes a groundwater control program. The Solid Waste Disposal Act and Resource Conservation and Recovery Act (RCRA) provide regulation of solid and hazardous waste, while the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), or Superfund, provides authority for the federal government to respond to releases of hazardous substances, and established a fee-maintained fund to clean up abandoned hazardous waste sites. The authority to collect fees has expired, and funding is now provided from general revenues. The Emergency Planning and Community Right-to-Know Act requires industrial reporting of toxic releases and encourages planning to respond to chemical emergencies. The Toxic Substances Control Act (TSCA) regulates the testing of chemicals and their use, and the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) governs pesticide products and their use.

Book Environmental Law in Development

Download or read book Environmental Law in Development written by N. Niessen and published by Edward Elgar Publishing. This book was released on 2006-01-01 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: . . . an important addition to the small, but growing, published literature on the development of environmental law in developing countries. It will be of interest to academics and those involved in law development in Indonesia and the other developing countries. Jennifer Mohamed-Katerere, Journal of Environmental Law This book asks whether environmental law and policy in developed countries can be successfully transferred to developing countries. It questions whether developing countries are indeed ready and able to implement new ideas from the developed world, such as the integration of environmental law, and use of market-oriented instruments. The authors draw insights from the case of Indonesia, where they have experience of drafting environmental legislation, and which is itself in the early stages of development. Through these insights they seek to understand why environmental law that has been well developed in theory, can in practice be difficult to monitor and adequately enforce. Indeed, a further question central to the book is why developing environmental law does not necessarily result in an efficient environmental policy. Taking a comparative perspective, and using a multi-faceted methodology that draws on constitutional and administrative law, human rights law, criminal and liability law and international law, as well as law and economics, the authors conclude with an outline of some of the lessons that can be learnt by other jurisdictions seeking to develop environmental law. Lawyers, environmental engineers and social scientists involved in environmental law and policy in developing countries will find much to interest them in this book, as will those concerned with development studies or with a particular interest in the case of Indonesia.
