The organisation’s supply of global governance falls short of global demand in areas ranging from health to environment, while intra-state armed conflicts are on the rise again, and fullblown inter-state war has returned to the agenda. At the same time, decision-making mechanisms are deadlocked, and their legitimacy is increasingly questioned. But what pathways are there for reinvigorating the United Nations? This book argues for consolidating key principles pertaining to inter-state relations and human rights, for elaborating on the UN system in order to avoid fragmentation and make it possible for it to keep pace with a changing world, and for revisiting UN decision-making structures so that it can become more inclusive and rebuild trust among stakeholders. Within the vast field of adjudication, the book addresses one of the most traditional sets of procedures, namely, the exercise of public powers affecting property rights. Following the method adopted in the CoCEAL project, this volume takes the fundamentals of expropriation in a given legal order as its starting point and examines various cases. The main requirements for property rights deprivations and restrictions are presented through national reports and discussed through hypotheticals, while the comparative analysis focuses on procedural propriety and fairness. This book is divided into three parts. The first part introduces the project and the topic. The second part covers the legal systems chosen for this study. This volume presents and compares the existing regulations and practices of emergencies and human rights protection in the Visegrad (V4) countries. As such, the analysis covers Czech Republic, Hungary, Poland, and Slovakia. Although these European countries share a common historical experience and are now members of the EU and NATO, they differ in some of their constitutional traditions and, also, in the dynamics of their political regimes.
