Book excerpt: Global climate change is occurring at an accelerating pace, and the global greenhouse gas (GHG) emissions that are forcing climate change continue to increase. Given the present pace of international actions, it seems unlikely that atmospheric composition can be stabilized at a level that will avoid 'dangerous anthropogenic interference' with the climate system, as called for in the UN Framework Convention on Climate Change. Complicating the situation, as GHG emissions are reduced, reductions in the offsetting cooling influence of sulfate aerosols will create an additional warming influence, making an early transition to climate stabilization difficult. With significant reductions in emissions (mitigation) likely to take decades, and with the impacts of projected climate change-even with proactive adaptation-likely to be quite severe over the coming decades, additional actions to offset global warming and other impacts have been proposed as important complementary measures. Although a number of possible geoengineering approaches have been proposed, each has costs and side effects that must be balanced against the expected benefits of reduced climate impacts. However, substantial new research is needed before comparison of the relative benefits and risks of intervening is possible. A first step in determining whether geoengineering is likely to be a useful option is the initiation of research on four interventions to limit the increasing serious impacts: limiting ocean acidification by increasing the removal of carbon dioxide from the atmosphere and upper ocean; limiting the increasing intensity of tropical cyclones; limiting the warming of the Arctic and associated sea level rise; and sustaining or enhancing the existing sulfate cooling influence. In addition, in depth consideration is needed regarding the governance structure for an international geoengineering decision-making framework in the event that geoengineering becomes essential.

Book excerpt: The “duty to mitigate loss” doctrine has been the object of study in many jurisdictions, which have interpreted and applied it in a wide range of situations and in different ways. In Brazil, however, only recent discussions have brought light to this subject. Worldwide, researchers have debated its nature – whether a duty or a principle – and the most proper way to address it (e.g.: if duty to mitigate loss or damages; duty to rescue; avoidable consequences doctrine). Studies have also detailed its application in different situations, such as in contracts and torts, among suppliers, consumers and national and international commerce, for instance. Ultimately, responding to the shift for globalized relations involving parties from different jurisdictions, the development of the doctrine and its standardization by Common Law courts, Civil Law codifications and international rules have allowed emerging countries to take advantage of the lessons learnt in more experienced systems and helped them regulate their own in the most suitable form. The purpose of this book is to provide an in-depth study of the “duty to mitigate loss” – from its origin to its current application in selected jurisdictions – so as to comprehensively come up with a proposition that is sufficiently adequate to fill the Brazilian legal framework gap diagnosed with respect to its effective regulation.

Book excerpt: Abstract: Nationally determined contributions (NDCs) were key to reaching the Paris Agreement and will be instrumental in implementing it. Research was quick to identify the 'headline numbers' of NDCs: if these climate action plans were fully implemented, global mean warming by 2100 would be reduced from approximately 3.6 to 2.7°C above pre-industrial levels (Höhne et al. Climate Pol 17:1-17, 2016; Rogelj et al. Nature 534:631-639, 2016). However, beyond these headline mitigation numbers, NDCs are more difficult to analyse and compare. UN climate negotiations have so far provided limited guidance on NDC formulation, which has resulted in varying scopes and contents of NDCs, often lacking details concerning ambitions. If NDCs are to become the long-term instrument for international cooperation, negotiation, and ratcheting up of ambitions to address climate change, then they need to become more transparent and comparable, both with respect to mitigation goals, and to issues such as adaptation, finance, and the way in which NDCs are aligned with national policies. Our analysis of INDCs and NDCs (Once a party ratifies the Paris Agreement, it is invited to turn its Intended Nationally Determined Contribution (INDC) into an NDC. We refer to results from our INDC analysis rather than our NDC analysis in this commentary unless otherwise stated.) shows that they omit important mitigation sectors, do not adequately provide details on costs and financing of implementation, and are poorly designed to meet assessment and review needs
