It reflects on how tradition and change can affect religious and secular legal reasoning, identifying the patterns of legal evolution within religious and secular traditions. It is often taken for granted that, even in law, change corresponds and correlates to progress – that things ought to be changed and they will necessarily get better. There is no doubt that legal changes over the centuries have made it possible to enhance the protection of individual rights and to somewhat contain the possibility of tyranny and despotism. But progress is not everything in law: stability and certainty lie at the core of the rule of law. Similarly, religions and religious laws could not survive without traditions; and yet, they still evolve, and their evolution is often intermingled with secular law. The book asks (and in some ways answers) the questions: What is the role of tradition within religions and religious laws? What is the impact of religious traditions on secular laws, and vice-versa? How are the elements of tradition to be identified? Are they the same within the secular and the religious realm? Do secular law and religious law follow comparable patterns of change? Do their levels of resilience differ significantly? How does the history of religion and law affect changes within religious traditions and legal systems? The overall focus of the book addresses the extent to which tradition plays a role in shaping and re-shaping secular and religious laws, as well as their mutual boundaries.

Book excerpt: Comparative Religious Law provides for the first time a study of the regulatory instruments of Jewish, Christian and Muslim religious organisations in Britain in light of their historical religious laws. Norman Doe questions assumptions about the pervasiveness, character and scope of religious laws, from the view that they are not or should not be recognised by civil law, to the idea that there may be a fundamental incompatibility between religious and civil law. It proposes that religious laws pervade society, are recognised by civil law, have both a religious and temporal character, and regulate wide areas of believers' lives. Subjects include sources of law, faith leaders, governance, worship and education, rites of passage, divorce and children, and religion-State relations. About the Author Alonzo T Jones (1850-1923) heard the Adventist message while serving in the United States Army in the State of Washington. He began at once to study history as it related to prophecy, a theme of much of his writing of articles and books. This study also prepared him for his activity on the subject of religious liberty. He participated in the hearings of the Blair Sunday bill in 1889 and became editor of "The American Sentinel." Elder Jones was a powerful speaker and one of the strong voices in the revival of 1888 within the Adventist denomination. For a short time he was a Bible teacher at Healdsburg College. From 1897-1901 he was the editor of the Review and Herald, and he served on the staff of the Signs of the Times. But what happens when a process of assimilation - whether imposed or voluntary - characterizes the relationships between the systems? This paper analyzes the fascinating process of assimilation of civil principles into religious law in the context of Jewish law and Israeli civil family law. Assimilation, as the paper shows, is not the whole picture. The paper reveals a corresponding (both open and implicit) struggle for the preservation of religious law principles despite the continuing efforts of civil law for their curtailment, or sometimes, elimination. The result, which is somewhat internally contradictory, leads the paper to suggest a normative pluralistic framework that enables both regimes - the civil and the religious - to preserve their core principles in family law matters.
