Download or read book The Bermuda Form written by David Scorey and published by Oxford University Press, USA. This book was released on 2018-02-15 with total page 592 pages. Available in PDF, EPUB and Kindle. Book excerpt: Providing analysis and interpretation on the construction of the Bermuda Form, this second edition also addresses the dispute resolution process and covers the legal and practical issues which arise in the international arbitration of large and complex disputes under it. The work has been thoroughly revised to take into account the major changes in the governing New York law since the first edition, as well as significant English case law such as AstraZeneca v ACE & XL. This case has had major implications for the interpretation of issues such as the recoverability of defence costs, assertion and proof of legal liability. The resulting trend towards brokers and insurers drafting endorsements intended to clarify intent, and the nature and efficacy of these endorsements, are also analysed in this edition. The implications for policyholders and insurers of the ACE Insurance Form 007 are also discussed at length. Providing valuable analysis of disputes involving the Bermuda Form, particularly concerning arbitrations, this work gives access to an otherwise closed arena and is an indispensible guide even for experienced practitioners in this field.

Download or read book Bermuda Shorts written by James Patterson and published by Santa Fe Writer's Project. This book was released on 2010-06-01 with total page 206 pages. Available in PDF, EPUB and Kindle. Book excerpt: In clothing, Bermuda Shorts are a kind of casual formal wear – and in this collection of essays, Bermuda Shorts is the perfect metaphor for James J. Patterson’s fundamentally serious but playful literary style. Patterson writes like the love child of Henry Miller and Mary Karr, with all the contradictions that implies — a philosopher who thinks best over a glass of fine wine; an ex-Catholic still haunted by the image of the Crucifixion; an irreverent political satirist whose patriotism flies the flag of another iconoclast, Thomas Paine. Patterson grew up with a foot planted in each of two worlds — one in Washington DC, the Capital of the Empire as he calls it, where the wheels of power spin, and one in rural Ontario, where his Canadian mother insisted the family spend their summers. His father, one of the wizards of twentieth century newspaper publishing, introduced him to the city’s wheels of money and power, which he would later navigate as an entrepreneur, starting his first business at 20. But those Canadian summers introduced him to a different world – one where a cedar strip boat was better than any car, and where the ghosts of those who'd previously inhabited the family’s island house floated out over the water of Lovesick Lake. It is those two worlds that blend in this collection, in reflections both serious and playful, on what it means to be a man, an artist, an iconoclast, a patriot, a lover, as the 20th century rolls over into the 21st.

Download or read book Liability Insurance in International Arbitration written by Richard Jacobs QC and published by Hart Publishing. This book was released on 2011-01-13 with total page 414 pages. Available in PDF, EPUB and Kindle. Book excerpt: JOINT WINNER OF THE BRITISH INSURANCE LAW ASSOCIATION BOOK PRIZE 2012 This is the second, revised edition, of what has become and was described by the English Court of Appeal in C v D as the standard work on Bermuda Form excess insurance policies. The Form, first used in the 1980s, covers liabilities for catastrophes such as serious explosions or mass tort litigation and is now widely used by insurance companies. It is unusual in that it includes a clause requiring disputes to be arbitrated under English procedural rules in London but, surprisingly, subject to New York substantive law. This calls for a rare mix of knowledge and experience on the part of the lawyers involved, each of whom will also be required to confront the many differences between English and US legal culture. A related feature of the Form is that the awards of arbitrators are confidential and not subject to the scrutiny of the courts. Therefore, while many lawyers have been involved in litigating on the Bermuda Form their knowledge remains locked away. The Bermuda Form is thus not well understood, a situation not helped by the lack of publications dealing with it. Accordingly, those required to deal with the Form professionally are confronted with a lengthy and complex document, but with very little to aid their understanding of it. This unique and comprehensive work offers a detailed commentary on how the Form is to be construed, its coverage, the substantive law to be applied, the limits of liability, exceptions, and, of course, the procedures to be followed during arbitration proceedings in London. This is a book which will prove invaluable to lawyers, risk managers, and executives of companies which purchase insurance on the Bermuda Form, and clients, lawyers or arbitrators involved in disputes arising therefrom. '...deserves to be in the library of anyone who is, or is contemplating becoming, a party to a Bermuda Form arbitration...The authors, whom we have been associated with in some cases and opposed in others, have a wealth of experience with the Bermuda Form and the ability to share that experience with their readers in a clear and engaging style.' From the foreword by Thomas R Newman and Bernard Eder QC
Download or read book Beyond the Bermuda Triangle written by Bruce Gernon and published by Red Wheel/Weiser. This book was released on 2017-07-24 with total page 224 pages. Available in PDF, EPUB and Kindle. Book excerpt: I didn’t believe in time travel or teleportation until it happened to me. I’m Bruce Gernon, and I flew through the heart of the Bermuda Triangle before I’d even heard the term. Skeptics have dismissed the Triangle as a nonmystery, but they weren’t in my airplane when the fog surrounded my craft and I leaped ahead 100 miles. I documented what happened and memorized every detail of that flight. Now I’m ready to explain that there is no Bermuda Triangle! Instead, there is a continuing mystery that has resulted in thousands of disappearances of crafts and loss of life over decades and centuries: a phenomenon I call electronic fog. In Beyond the Bermuda Triangle, Rob MacGregor and I present multiple cases of pilots and others who have experienced electronic fog in the air, in the water, and on land. We also examine UFO and USO cases and their possible relationship with space/time warps. Among the fascinating topics we explore: Time travel and teleportation. Lost crafts, including Flight 19. The Dragon’s Triangle. The Underwater Area 51. The man who is building a warp drive. A remote viewer who takes on the Triangle.
Download or read book Filthy Beasts written by Kirkland Hamill and published by Simon and Schuster. This book was released on 2021-06-08 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: Running with Scissors meets Grey Gardens in this “vivid tragicomedy” (People), a riveting riches-to-rags tale of a wealthy family who lost it all and the unforgettable journey of a man coming to terms with his family’s deep flaws and his own hidden secrets. “Wake up, you filthy beasts!” Wendy Hamill would shout to her children in the mornings before school. Startled from their dreams, Kirk and his two brothers couldn’t help but wonder—would they find enough food in the house for breakfast? Following a hostile exit from New York’s upper-class society, newly divorced Wendy and her three sons are exiled from the East Coast elite circle. Wendy’s middle son, Kirk, is eight when she moves the family to her native Bermuda, leaving the three young boys to fend for themselves as she chases after the highs of her old life: alcohol, a wealthy new suitor, and other indulgences. After eventually leaving his mother’s dysfunctional orbit for college in New Orleans, Kirk begins to realize how different his family and upbringing is from that of his friends and peers. Split between rich privilege—early years living in luxury on his family’s private compound—and bare survival—rationing food and water during the height of his mother’s alcoholism—Kirk is used to keeping up appearances and burying his inconvenient truths from the world, until he’s eighteen and falls in love for the first time. A keenly observed, fascinating window into the life of extreme privilege and a powerful story of self-acceptance, Filthy Beasts is “a stunning, deeply satisfying story about how we outlive our upbringings” (Kirkus Reviews, starred review).
