All of these aviation-related aspects are addressed in a 75-year-old treaty called the Chicago Convention and its Annexes, which, as this book argues, needs to be reviewed with a focus on its relevance and applicability in connection with Moore’s Law, which posits that transistors in computer microchips double in speed, power and performance every two years, while the cost of computers is halved during the same period. Firstly, in terms of traditional territorial sovereignty, we have arrived at a point where there is a concept of data sovereignty and ownership that raises issues of privacy. Data transmission becomes ambivalent in terms of territorial sovereignty, and the Westphalian model may not be the perfect answer. Whether it be the manufacture of airplanes, the transfer of data on individuals, or the transmission of aeronautical and telecommunications information – all have to be carried out in accordance with the same fundamental principle: duty of care. Though necessary to regular operations, these modern computing and communications systems provide a greater attack surface for criminals, terrorists, or nation-states to exploit and thereby increase the potential for cybersecurity threats to the NAS and its constituents. The future safety and security of air travel will rely in part on the ability of the FAA to build a workforce capable of addressing the evolving cybersecurity threat landscape. Securing the computers, networks, and data that underpin modern aviation depends in part on the FAA having enough cybersecurity professionals (capacity) with the right knowledge, skills, and abilities (capability)). It also depends on the FAA's workforce having sufficient diversity of backgrounds and experience. Such diversity is critical in analyzing cybersecurity problems and widely understood to be a functional imperative for effective cybersecurity programs. At the request of Congress, the publication examines the FAA's cybersecurity workforce challenges, reviews the current strategy for meeting those challenges, and recommends ways to strengthen the FAA's cybersecurity workforce.

Additionally, shortcomings in boundary protection controls between less-secure systems and the operational NAS environment increase the risk from these weaknesses. The objective of this book is to evaluate the extent to which FAA has effectively implemented information security controls to protect its air traffic control systems. This book also identifies the cybersecurity challenges facing FAA as it shifts to the NextGen ATC system and how FAA has begun addressing those challenges; and assesses the extent to which FAA and its contractors, in the acquisition of NextGen programs, have followed federal guidelines for incorporating cybersecurity controls.
